Ya’Mar provides messaging tools that allow buyers and sellers to communicate directly through the Platform regarding listings, orders, shipping, disputes, bundles, returns, customer support matters, and other marketplace-related activities.

Messages are intended to be private between participating users; however, Ya’Mar may access, review, retain, process, or disclose message content and attachments in limited circumstances to protect users, maintain Platform integrity, provide customer support, enforce Platform Policies, prevent fraud, investigate misconduct, comply with legal obligations, or operate the marketplace.

By using Ya’Mar messaging features, you acknowledge and agree to the practices described in this Notice.

How Messaging Works

Messaging is provided to facilitate marketplace transactions and communications between buyers and sellers. Users are responsible for all content, attachments, documents, images, links, files, and communications transmitted through the Platform.

Users should not assume that messages are encrypted end-to-end or that communications are immune from lawful access, review, disclosure, retention, or enforcement activities permitted under applicable law or Platform Policies.

When Ya’Mar May Review Messages

Ya’Mar does not engage in unrestricted, continuous, or real-time monitoring of all user communications.

However, Ya’Mar may access, review, analyze, process, or retain messages and attachments when reasonably necessary to:

  • Investigate fraud, scams, deceptive activity, or marketplace abuse

  • Detect prohibited conduct, harassment, threats, spam, or policy violations

  • Protect users, the Platform, payment systems, or marketplace operations

  • Respond to support requests or disputes

  • Verify transaction-related information

  • Investigate reports submitted by users

  • Review appeals, chargebacks, refund requests, returns, or claims

  • Detect off-platform transaction attempts

  • Verify compliance with marketplace rules

  • Comply with subpoenas, court orders, warrants, regulatory requests, law enforcement requests, or other legal obligations

  • Protect the rights, safety, property, reputation, operations, or legal interests of Ya’Mar, its users, or third parties

Message review may be performed through automated systems, machine-learning tools, fraud-detection systems, moderation tools, human review, or a combination thereof.

Automated Monitoring and Safety Systems

Ya’Mar may use automated technologies to detect activity associated with fraud, scams, prohibited transactions, policy violations, account abuse, suspicious behavior, malware, spam, harassment, counterfeit goods, intellectual property violations, payment abuse, or other risks.

Automated systems may flag messages, attachments, accounts, listings, or transactions for additional review.

Automated review does not necessarily mean a violation has occurred.

Message Retention

Ya’Mar may retain message content, attachments, metadata, reports, moderation records, and related communications for as long as reasonably necessary to:

  • Provide Platform services

  • Support transactions

  • Resolve disputes

  • Investigate violations

  • Maintain security

  • Prevent fraud

  • Meet legal, tax, regulatory, accounting, audit, or compliance obligations

  • Enforce Platform Policies

Retention periods may vary depending on account activity, transaction history, legal requirements, dispute status, fraud investigations, or operational needs.

Documents and Attachments Shared Through Messaging

Users may choose to exchange documents and attachments through messaging, including invoices, resale certificates, business documentation, shipping information, photographs, product information, tax-related documents, or other materials.

Except as otherwise stated by Ya’Mar, documents exchanged between users are not routinely reviewed, verified, authenticated, approved, certified, validated, endorsed, or guaranteed by Ya’Mar.

Users remain solely responsible for the legality, accuracy, authenticity, completeness, security, ownership, and use of materials exchanged through messaging.

Ya’Mar may review attachments when reasonably necessary for fraud prevention, customer support, policy enforcement, dispute resolution, legal compliance, marketplace safety, or operational purposes.

What Ya’Mar Does Not Do

Ya’Mar does not:

  • Sell private message content

  • Use private messages to create advertising profiles

  • Guarantee the legality, truthfulness, completeness, or accuracy of user communications

  • Verify every document shared between users

  • Guarantee successful transactions based on communications

  • Act as an escrow service

  • Act as a legal advisor, accountant, tax professional, customs broker, or document verification service

  • Guarantee confidentiality beyond the protections described in Platform Policies and applicable law

User Responsibilities

Users must communicate lawfully, honestly, and respectfully.

Users may not use messaging to:

  • Harass, threaten, intimidate, or abuse others

  • Send fraudulent, deceptive, misleading, or unlawful communications

  • Circumvent Platform fees or transaction requirements

  • Solicit off-platform transactions

  • Share malware, malicious files, harmful links, or unauthorized software

  • Violate intellectual property rights

  • Send spam or unsolicited commercial communications

  • Engage in prohibited conduct under Ya’Mar Policies

Misuse of messaging features may result in content removal, warnings, message restrictions, listing removal, account limitations, suspension, termination, legal action, or other enforcement measures.

Privacy and Disclosure

Message content may be disclosed where reasonably necessary to:

  • Provide Platform services

  • Investigate violations

  • Resolve disputes

  • Process support requests

  • Respond to legal obligations

  • Protect users, Ya’Mar, or third parties

  • Enforce Platform Policies

No Guarantee of Absolute Confidentiality

Although Ya’Mar takes reasonable measures to protect user information, no messaging system can guarantee absolute privacy, confidentiality, security, or protection from unauthorized access.

Users should exercise caution when sharing sensitive personal, financial, legal, business, or tax-related information.
