Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) respects your privacy and is committed to protecting personal information and personal data. This Privacy Policy explains how we collect, use, disclose, transfer, store, retain, secure, safeguard, analyze, monitor, and process information when you access or use the Ya’Mar marketplace application, website, software, systems, communications, or related services (collectively, the “Platform”). This revised version expands and updates your existing Privacy Policy.
This Policy applies to users located in the United States, Canada, the United Kingdom, the European Union, and other supported jurisdictions and is intended to comply with applicable privacy and data protection laws including the California Consumer Privacy Act (“CCPA”), California Privacy Rights Act (“CPRA”), General Data Protection Regulation (“GDPR”), UK GDPR, applicable Canadian privacy laws, the Children’s Online Privacy Protection Act (“COPPA”), and other applicable privacy, data protection, consumer protection, or electronic communications laws.Ya’Mar LLC is the data controller responsible for personal data processed through the Platform where required under applicable law.
This Privacy Policy is incorporated into and forms part of the Ya’Mar Terms of Service and operates together with the Personal Data Protection & GDPR Compliance Policy, California Privacy Notice, Cookie Policy, Community Guidelines, Returns & Refund Policy, Shipping & Delivery Policy, Seller Standards & Performance Policy, Appeals & Dispute Review Policy, Messaging Privacy, Review & Content Access Notice, Seller Verification Policy, Intellectual Property & Counterfeit Policy, Trademark & Brand Usage Guidelines, and all other incorporated Platform Policies.
1. Information We Collect
Ya’Mar collects information provided directly by users, information collected automatically through use of the Platform, information received from third parties, and information reasonably necessary to operate, maintain, improve, secure, verify, protect, enforce, and support the Platform and related services.
Information collected may include legal name, username, email address, phone number, mailing address, billing address, shipping address, account credentials, profile information, account settings, user preferences, communication preferences, storefront information, business information, and seller information.
We may collect and verify mobile phone numbers for OTP authentication, login verification, fraud prevention, account recovery, transaction verification, identity verification, seller verification, abuse prevention, and Platform integrity purposes. By providing a phone number, users consent to receive authentication messages, verification codes, transactional notices, security alerts, legal notices, and account-related communications. Message and data rates may apply depending on the user’s carrier or mobile plan. Users represent and warrant that they are authorized to use submitted phone numbers.
Where required by law, Platform Policies, fraud prevention systems, verification providers, shipping providers, payment processors, operational reviews, or marketplace integrity reviews, Ya’Mar may collect government-issued identification, business records, tax-related documentation, seller verification information, identity verification materials, banking verification information, beneficial ownership information, payout verification information, sourcing documentation, customs documentation, inventory verification materials, invoices, receipts, address verification information, compliance documentation, or related records. Where identity verification is required, Ya'Mar or its authorized verification providers may collect photographs, selfies, government-issued identification documents, facial images, and related identity verification materials for seller verification, fraud prevention, legal compliance, payment processor requirements, and marketplace security. Verification services, sanctions screening, fraud reviews, identity verification, payment verification, tax verification, beneficial ownership verification, document verification, compliance reviews, and related verification activities may be performed by Ya’Mar, payment processors, identity verification providers, fraud prevention vendors, financial institutions, sanctions screening providers, compliance vendors, or other authorized service providers including Stripe and affiliated service providers.
We may collect transaction-related information including purchase history, sales history, listing information, order information, bidding activity, shipping details, return activity, refund activity, dispute activity, appeal activity, chargeback history, payout records, reserve information, transaction communications, seller performance records, Ya’Mar Shield claim information, and fraud prevention indicators.
Payments are processed securely through third-party payment processors including Stripe and affiliated service providers. Ya’Mar does not store full payment card numbers. We may receive limited payment-related information including payment status, transaction identifiers, payout information, billing details, reserve information, tax-related processing information, partial payment details, refund information, chargeback information, fraud indicators, and payment verification indicators.
Shipping label generation, shipment tracking, postage calculations, customs-related processing, address verification, carrier integrations, and shipping-related services may be facilitated through third-party providers including ShipEngine and affiliated carriers. We may collect shipping addresses, recipient information, carrier information, shipment history, delivery status, tracking information, return shipping information, carrier surcharge information, postage adjustment information, shipping overage information, customs-related information, and delivery dispute information.
We may automatically collect technical and device information including device identifiers, browser type, operating system details, mobile carrier information, IP address, timestamps, app version, diagnostics, crash reports, usage data, approximate location information, session activity, authentication activity, technical logs, fraud indicators, behavioral indicators, and related technical activity.
We may collect Platform activity and usage information including listing interactions, search activity, bidding activity, viewing activity, messaging activity, customer support communications, seller activity, buyer activity, dispute activity, appeal activity, reporting activity, review activity, advertising engagement, referral activity, and user behavior patterns.
Ya’Mar may collect, process, review, retain, analyze, disclose, investigate, preserve, moderate, or otherwise use messages, attachments, uploaded files, communications, metadata, transaction-related communications, support communications, dispute communications, reports, and related messaging activity where reasonably necessary for fraud prevention, dispute resolution, customer support, legal compliance, Platform security, marketplace integrity, enforcement of Platform Policies, operational purposes, or protection of users, Ya’Mar, or third parties, as further described in the Messaging Privacy, Review & Content Access Notice.
Depending on user settings and device permissions, the Platform may request access to device features including camera access, microphone access, storage, notifications, contacts, location services, and photo libraries.
Ya’Mar may use cookies, SDKs, pixels, device identifiers, analytics technologies, attribution technologies, authentication technologies, advertising technologies, local storage technologies, fraud prevention technologies, recommendation technologies, and similar tracking systems to maintain Platform functionality, authenticate users, personalize experiences, support operational systems, improve performance, support analytics systems, measure advertising effectiveness, protect Platform security, improve marketplace operations, and enforce Platform Policies.
Third-party analytics providers, fraud prevention providers, telecommunications providers, shipping providers, payment processors, advertising providers, marketing providers, attribution providers, cloud hosting providers, customer support providers, and operational providers may also collect information through cookies, SDKs, APIs, pixels, or similar technologies.
2. Legal Bases for Processing
Where required under applicable law, Ya’Mar processes personal data based upon contractual necessity, legitimate interests, legal obligations, fraud prevention needs, Platform integrity protection, operational protection, security monitoring requirements, payment processing requirements, customs compliance obligations, shipping operations, dispute handling, collections activity, enforcement of agreements, and user consent where required by law.
Legitimate interests may include fraud prevention, Platform security, identity verification, payment processing, shipping processing, customs compliance, seller verification, customer support, recommendation systems, analytics systems, dispute resolution, chargeback handling, collections activity, marketplace integrity, operational improvements, abuse prevention, Platform functionality, intellectual property protection, legal compliance, and enforcement of agreements.
Consent may be withdrawn where permitted by law; however, certain Platform functionality may become unavailable if required information, permissions, tracking technologies, authentication data, shipping information, payment information, or verification information is withdrawn.
3. How We Use Information
Ya’Mar uses personal information to operate, maintain, improve, personalize, monitor, secure, enforce, and provide the Platform and related services.
Information may be used to facilitate transactions between users, process payments, process refunds, support reserves, process reversals, support payouts, process payout holds, support shipping operations, generate shipping labels, support shipment tracking, support customs processing, provide OTP verification, support identity verification, provide customer support, investigate disputes, process appeals, process returns, review Ya’Mar Shield claims, enforce Platform Policies, pursue collections activity, recover outstanding balances, support chargeback investigations, payment dispute reviews, recovery of chargeback-related amounts, collection activities, and enforcement of chargeback-related obligations support arbitration, pursue legal claims, and comply with legal or regulatory obligations. Information may additionally be used to detect and prevent fraud, prohibited conduct, suspicious activity, return abuse, chargeback abuse, account compromise, seller performance abuse, counterfeit activity, manipulated evidence, customs fraud, shipping fraud, scraping attempts, automated abuse, deceptive conduct, abusive behavior, operational abuse, policy violations, or security threats. Information may also be used to investigate intellectual property complaints, counterfeit reports, authenticity reviews, rights-owner complaints, infringement claims, seller verification reviews, trademark disputes, copyright complaints, DMCA notices, licensing disputes, and related compliance investigations.
Ya’Mar may use listings, marketplace interactions, uploaded content, Platform activity, behavioral information, transaction history, technical information, user activity, and operational data to improve AI-assisted moderation systems, fraud detection systems, recommendation systems, machine learning systems, analytics systems, abuse prevention systems, search systems, operational systems, customer support systems, Platform functionality, seller performance systems, and marketplace integrity systems where permitted by law.
Public listings, storefronts, usernames, shop names, product images, descriptions, branding materials, videos, reviews, ratings, marketplace activity, and related marketplace content may be displayed publicly and may be used in connection with Platform promotion, featured listings, recommendation systems, social media marketing, email marketing, app store materials, marketplace showcases, Platform branding, operational systems, analytics systems, fraud prevention systems, AI-assisted moderation systems, advertising, search indexing, business development, and related marketplace functionality.
Information may additionally be used to send transactional notices, authentication notices, OTP messages, legal notices, policy updates, customer service communications, operational notices, account notices, dispute communications, marketing communications where permitted by law, and promotional communications where permitted by law.
4. Sharing and Disclosure of Information
Ya’Mar shares information only as reasonably necessary to operate the Platform, facilitate transactions, enforce Platform Policies, maintain marketplace integrity, process payments, support shipping operations, protect users, protect Platform security, support dispute handling, support fraud prevention efforts, comply with legal obligations, or protect operational systems.
Information may be shared with payment processors including Stripe, shipping providers including ShipEngine, authentication providers, OTP providers, telecommunications providers, fraud prevention providers, verification vendors, analytics providers, attribution providers, advertising providers, cloud hosting providers, customer support systems, shipping carriers, customs-related providers, infrastructure providers, collection agencies, professional advisors, regulators, arbitrators, financial institutions, dispute resolution providers, card networks, law enforcement agencies, rights holders, courts, government authorities, affiliated service providers, contractors, and operational providers where reasonably necessary for operational, legal, fraud prevention, customs, payment, shipping, security, dispute, tax, enforcement, or collections purposes.
Information may be shared with intellectual property rights holders, authorized representatives, authenticity reviewers, brand protection partners, licensors, distributors, verification providers, fraud prevention providers, and legal representatives where reasonably necessary to investigate intellectual property violations, counterfeit activity, authenticity concerns, fraud prevention matters, seller verification reviews, legal compliance obligations, or enforcement of Platform Policies.
Transaction-related information may also be shared between buyers and sellers to facilitate fulfillment, shipping, returns, refunds, support, legal compliance, tax obligations, customs processing, delivery verification, and marketplace communications.
Ya’Mar may disclose information where reasonably necessary to enforce the Terms of Service, investigate suspicious activity, preserve evidence, respond to subpoenas or legal process, cooperate with regulators, cooperate with payment processors, cooperate with shipping providers, cooperate with customs authorities, cooperate with rights holders, or cooperate with law enforcement agencies.
Ya’Mar may transfer information in connection with mergers, acquisitions, ownership changes, financing transactions, bankruptcy proceedings, corporate reorganizations, asset sales, or similar business transfers.
Ya’Mar does not sell personal information as defined under applicable privacy laws.
Ya’Mar does not knowingly share personal information for cross-context behavioral advertising purposes except as permitted by applicable law and disclosed within this Policy, the Cookie Policy, or the California Privacy Notice.
5. Cookies and Tracking Technologies
Ya’Mar uses cookies and similar technologies to maintain Platform functionality, authenticate users, support security systems, personalize user experiences, prevent fraud, support analytics systems, support attribution systems, support advertising measurement, support recommendation systems, improve Platform performance, measure marketing effectiveness, and maintain marketplace integrity.
Tracking technologies may include cookies, SDKs, pixels, authentication technologies, device identifiers, local storage technologies, analytics technologies, fraud prevention technologies, recommendation technologies, advertising technologies, and performance monitoring technologies.
Users may manage certain cookie settings through browser settings, device settings, application permissions, or available Platform controls. Disabling certain technologies may affect Platform functionality, authentication systems, fraud prevention systems, messaging systems, checkout functionality, saved preferences, or account access.
Unless otherwise required by law, the Platform may not respond to browser-based “Do Not Track” signals.

Where required by Apple App Tracking Transparency (ATT) requirements, users will be presented with permission requests before tracking occurs across apps and websites owned by other companies.
Users may manage tracking permissions through their device settings at any time.
6. User Rights and Choices
Depending on applicable law and jurisdiction, users may possess rights relating to access, correction, deletion, restriction of processing, objection to processing, withdrawal of consent, data portability, and certain rights relating to automated decision-making or profiling.
California residents may possess additional rights under the CCPA and CPRA as described within the California Privacy Notice.
Users may exercise applicable rights through account settings where available or by contacting Ya’Mar directly. Requests may require identity verification, fraud prevention review, operational review, security validation, account authentication, or additional documentation before processing.
Certain requests may be limited, delayed, or denied where retention or processing remains reasonably necessary for fraud prevention, Platform security, dispute handling, chargeback handling, customs compliance, tax obligations, legal compliance, operational protection, enforcement of agreements, payment processor requirements, collections activity, arbitration, protection of other users, or marketplace integrity.
Users may opt out of certain marketing communications through unsubscribe links, communication preferences, account settings, or available device controls. Transactional, legal, authentication, security, and operational communications may still be sent where necessary.
Residents of certain U.S. states may possess additional privacy rights under applicable state privacy laws including, but not limited to, California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other jurisdictions that provide consumer privacy rights.
Ya'Mar will honor applicable privacy rights requests as required by law.
7. Automated Systems, AI, and Profiling
Ya’Mar may use automated systems, AI-assisted moderation systems, fraud detection systems, recommendation systems, behavioral analysis technologies, machine learning systems, image analysis technologies, risk-scoring systems, and operational monitoring systems to operate, secure, improve, and protect the Platform.
These systems may be used to review listings, identify prohibited items, detect suspicious conduct, monitor seller performance, evaluate transaction risk, investigate disputes, detect counterfeit concerns, review chargeback activity, monitor return abuse, prevent scraping attempts, support customer service, personalize limited Platform experiences, recommend content, moderate content, enforce Platform Policies, maintain marketplace integrity, and protect users.
Certain moderation, fraud prevention, recommendation, payout review, dispute handling, verification, enforcement, or operational decisions may involve automated processing systems.
Users may request additional information regarding certain automated processing activities where required by applicable law.
8. Data Retention and Security
Ya’Mar retains personal information only for as long as reasonably necessary to operate the Platform, fulfill the purposes described in this Policy, comply with legal obligations, process chargebacks, resolve disputes, support customs processing, maintain operational records, investigate fraud, maintain security, support tax obligations, process arbitration matters, pursue collections activity, enforce agreements, and protect marketplace integrity.
Retention periods may vary depending upon operational necessity, fraud prevention needs, dispute history, customs obligations, tax obligations, legal compliance requirements, chargeback risk, arbitration matters, security investigations, shipping provider requirements, payment processor requirements, regulatory obligations, operational protection concerns, or collections activity.
Information may continue to be retained after account closure, suspension, restriction, or termination where reasonably necessary for fraud prevention, dispute handling, collections activity, chargeback management, arbitration, customs obligations, tax obligations, security investigations, legal compliance, operational protection, or enforcement of agreements.
Verification records, identity verification information, authenticity documentation, invoices, receipts, licensing records, sourcing records, rights-owner reports, intellectual property complaints, messaging records, moderation records, and fraud prevention records may be retained for compliance, legal, operational, audit, dispute resolution, fraud prevention, marketplace integrity, tax reporting, security, verification, or enforcement purposes. Face data, selfies, facial images, identity verification documents, and related verification records may be retained for as long as reasonably necessary to complete verification, prevent fraud, comply with legal obligations, satisfy payment processor requirements, support audits, resolve disputes, enforce Platform Policies, and maintain marketplace integrity.
Examples of retention periods may include:
• Account Information – Until account deletion
• Transaction Records – Up to 7 years
• Tax Records – Up to 7 years
• Customer Support Records – Up to 3 years
• Security Logs – Up to 2 years
• Fraud Prevention Records – Up to 10 years
• Chargeback Records – Up to 10 years
Actual retention periods may vary based upon legal, operational, fraud prevention, dispute resolution, security, tax, customs, regulatory, or compliance requirements.
Ya’Mar implements commercially reasonable technical, organizational, and administrative safeguards designed to protect personal data including authentication systems, monitoring systems, access controls, encryption where appropriate, security reviews, fraud prevention systems, operational security procedures, and related security measures.
No method of transmission or storage is completely secure, and Ya’Mar cannot guarantee absolute security.
Users remain responsible for protecting devices, authentication methods, account credentials, email accounts, phone numbers, payment methods, and related security information associated with Platform accounts.
Where required by applicable law, Ya’Mar may notify affected users, regulators, payment processors, customs authorities, law enforcement agencies, or other authorities regarding certain qualifying security incidents or data breaches.
9. Account Deletion and Data Removal
Users may permanently delete their Ya'Mar Marketplace account through:
Settings > Delete Account
Upon submission of a deletion request, account information will be scheduled for deletion.
Information that may be deleted includes:
• Profile information
• Saved addresses
• Favorites and watchlists
• Listings
• User-accessible messages and message history, subject to applicable retention requirements described in this Privacy Policy.
• Wholesale requests
• Auction activity
• Account settings
• Other personal information associated with the account
Certain information may be retained where reasonably necessary for:
• Legal compliance
• Fraud prevention
• Chargeback management
• Tax reporting
• Security investigations
• Dispute resolution
• Enforcement of Platform Policies
Deletion requests are typically processed within 30 days.
10. International Data Transfers
Personal data may be processed, transferred, stored, or accessed within the United States, Canada, the United Kingdom, the European Union, or other jurisdictions where Ya’Mar or its service providers operate.
Where required by law, Ya’Mar implements legally recognized safeguards for international data transfers including contractual safeguards, recognized transfer mechanisms, adequacy decisions, Standard Contractual Clauses, or other lawful transfer protections.
Users acknowledge that certain jurisdictions may not provide the same level of privacy protections as their home jurisdiction.
11. User Content, Attribution, and Public Information
Information users choose to make public through the Platform including listings, storefronts, usernames, reviews, ratings, bids, comments, branding materials, uploaded content, product descriptions, photos, videos, or other public-facing information may be visible to other users or the public.
Public content may appear in search engine results, recommendation systems, Platform advertising, social media marketing, marketplace showcases, app store materials, featured listings, cached systems, or third-party services outside Ya’Mar’s reasonable control.
Users remain solely responsible for uploaded, displayed, transmitted, posted, distributed, or shared content and represent and warrant that they possess all necessary rights, permissions, licenses, and authorizations for uploaded content.
Where attribution is legally required for Creative Commons materials, licensed content, royalty-free materials, or third-party content, users remain solely responsible for complying with attribution obligations and applicable licensing requirements.
By uploading or posting content to the Platform, users grant Ya’Mar a worldwide, non-exclusive, sublicensable, royalty-free license to host, store, reproduce, display, distribute, process, analyze, promote, advertise, market, moderate, adapt, format, and otherwise use such content in connection with operating, securing, improving, enforcing, marketing, promoting, analyzing, and maintaining the Platform and related services.
Ya’Mar reserves the right, but not the obligation, to monitor, preserve, review, moderate, disclose, suppress, demonetize, remove, investigate, disable access to, or restrict user-generated content where reasonably necessary to enforce Platform Policies, investigate disputes, prevent fraud, protect users, comply with legal obligations, protect operational systems, maintain marketplace integrity, or protect rights, safety, property, or security.
User content may also be reviewed, analyzed, preserved, disclosed, investigated, restricted, or removed in connection with intellectual property complaints, counterfeit investigations, authenticity reviews, rights-owner reports, seller verification reviews, fraud prevention efforts, or enforcement of Platform Policies.
12. Children’s Privacy
The Platform is intended primarily for individuals eighteen (18) years of age or older and is not directed toward children under thirteen (13) years of age.
Minors under eighteen (18) years old may only access limited Platform features under the direct supervision, involvement, authorization, and responsibility of a parent or legal guardian who is at least eighteen (18) years old.
Accounts used by minors must remain under the control and supervision of the adult account holder. The parent or legal guardian assumes full responsibility for Platform activity, communications, purchases, bids, sales, disputes, uploaded content, taxes, chargebacks, financial obligations, and compliance with Platform Policies.
Ya’Mar does not knowingly permit minors to independently create accounts, complete transactions, submit bids, receive payouts, or use transactional Platform features where prohibited by law.
If Ya’Mar becomes aware that information has been collected from a child or minor in violation of this Policy or applicable law, Ya’Mar may delete such information, restrict associated accounts, or take additional enforcement action where reasonably necessary or required by law.
13. Fraud Prevention and Platform Enforcement
To maintain marketplace integrity and protect users, Ya’Mar may monitor account activity, device information, communications conducted through the Platform, dispute activity, shipping activity, customs-related activity, chargeback behavior, transaction history, listings, operational activity, technical activity, behavioral patterns, seller performance activity, fraud indicators, and related risk indicators.
Ya’Mar may investigate suspicious activity, hold or reverse funds, freeze transactions, delay payouts, impose reserves, recover outstanding balances, assess chargeback administration fees, recover chargeback-related amounts, place reserves, hold funds, debit authorized payment methods where permitted by law, refer matters to collections agencies, pursue arbitration, restrict accounts, terminate accounts, cooperate with regulators, cooperate with payment processors, cooperate with customs authorities, cooperate with rights holders, cooperate with shipping providers, cooperate with law enforcement agencies, or pursue legal enforcement where permitted by law.
14. Third-Party Services and Links
The Platform may contain links to third-party websites, applications, processors, carriers, advertisements, APIs, integrations, or services not operated by Ya’Mar.
Ya’Mar is not responsible for the privacy practices, security practices, service interruptions, outages, operational disruptions, customs delays, carrier failures, processor outages, shipping delays, content, advertising, or conduct of third-party services outside Ya’Mar’s reasonable control.
Third-party providers remain subject to their own terms, privacy practices, operational procedures, and policies.
15. Biometric Data Disclosure, Face Data, and Identity Verification
15A. Device Biometric Authentication (Face ID and Touch ID)
Where supported by a user's device, Ya'Mar may allow users to authenticate access to their account, approve actions, log in, or access certain Platform features using Apple Face ID, Touch ID, Android biometric authentication, or similar device-level authentication technologies.
Biometric authentication used for device access is performed entirely by the user's device operating system. Ya'Mar does not collect, receive, access, create, store, process, retain, or share facial recognition templates, fingerprint templates, biometric scans, or biometric authentication data generated by Face ID, Touch ID, or similar device-level authentication systems.
When device biometric authentication is enabled, Ya'Mar receives only confirmation from the operating system that authentication was successful or unsuccessful. Ya'Mar does not have access to, receive, collect, store, or process the user's Face ID data, facial recognition template, fingerprint template, or biometric authentication data generated by the device.
15B. Face Data and Identity Verification
Ya'Mar may request users to submit photographs, selfies, government-issued identification documents, identity verification materials, or similar information as part of seller verification, account security, fraud prevention, payment processor requirements, regulatory compliance obligations, Know Your Customer (KYC) requirements, Anti-Money Laundering (AML) obligations, marketplace integrity reviews, or related verification processes.
Face data collected through submitted selfies, photographs, or identity verification materials may be used solely to verify identity, confirm that submitted identification documents belong to the account holder, detect fraud, prevent account misuse, comply with legal obligations, satisfy payment processor requirements, and maintain Platform security and marketplace integrity.
Face data is collected only when voluntarily submitted by users as part of an identity verification process and is not collected during normal browsing, purchasing, messaging, listing creation, or general use of the Platform.
Face data is not used to identify users across unrelated applications, services, websites, or third-party platforms.
Identity verification services may be provided by Ya'Mar, Stripe Identity, payment processors, verification providers, fraud prevention vendors, compliance providers, or affiliated service providers authorized to perform identity verification and compliance reviews.
Users may decline to provide face data; however, seller verification, payouts, selling privileges, or certain Platform features may be unavailable if required verification cannot be completed.
Face data and identity verification materials may be stored by Ya'Mar, Stripe Identity, payment processors, verification providers, cloud service providers, or authorized compliance providers using commercially reasonable security measures. Storage locations may include the United States or other jurisdictions where Ya'Mar or its authorized service providers operate, process data, or maintain infrastructure, subject to applicable privacy, security, and legal requirements.

To the fullest extent permitted by law, Ya’Mar disclaims liability for unauthorized access, cyberattacks, technical failures, service interruptions, customs delays, carrier delays, data loss, third-party conduct, processor outages, telecommunications interruptions, operational disruptions, shipping failures, security incidents, cloud outages, fraud, or events outside Ya’Mar’s reasonable control.
