Ya’Mar Terms of Service

Introduction: These Terms of Service (“Terms”) form a legal agreement between you (“User,” “you”) and Ya’Mar LLC (“Company,” “Ya’Mar,” “we,” “our,” or “us”), governing your access to and use of the Ya’Mar mobile application, website, and services (“Application” or “Service”).By accessing or using Ya’Mar, you agree to comply with and be bound by these Terms and all related policies. If you do not agree, you must not use the Application. Policies Incorporated by Reference. 1. EligibilityTo use Ya’Mar, you must: Be at least 18 years old. Reside in the United States, Canada, or the United Kingdom, have the legal capacity to enter into binding agreements, and provide accurate and truthful information during registration.

 

2. About Ya’Mar. Ya’Mar is a peer-to-peer marketplace. We do not own or sell listed items. We facilitate transactions between independent users.Payments, refunds, and payouts are securely processed within the Ya’Mar app using our secure payment processor with encrypted financial infrastructure. Sellers are responsible for product accuracy, lawful listings, fulfillment, and taxes.

 

3. Account Creation & Security: Each user may maintain only one account. You must provide true and verifiable information. You are responsible for keeping your password and login details secure. Impersonation, false identities, or unauthorized account access are prohibited. We may require identity or tax verification when legally required or for fraud prevention.

 

4. Intellectual Property Rights: All trademarks, logos, branding, code, features, and content of Ya’Mar are owned by Ya’Mar LLC or licensed to us. Users may not reproduce, display, sell, or exploit platform materials without written permission.

 

5. User-Generated Content & Copyright Responsibility: Users may upload content such as videos, music, images, text, listings, or digital files (“User Content”). By uploading, you confirm you own the content or have legal rights/licenses to use it.You must not upload copyrighted music, audio, video, artwork, or any other protected material unless: You created it, You licensed it properly, orIt is royalty-free or in the public domain. You are solely responsible for your uploaded content. Ya’Mar is not liable for unauthorized or copyrighted material posted by users.Ya’Mar may remove content, restrict payouts, or suspend accounts that violate copyright rules or receive DMCA complaints. You agree to indemnify and hold harmless Ya’Mar LLC from any claims, losses, or legal actions arising from your uploaded content.

 

6. Electronic Communication Consent: By using the Service, you consent to receive legal notices, disclosures, and communications electronically. You must maintain a valid and monitored email address.

 

7. Buying on Ya’Mar: Buyers agree to pay the listed price, shipping, and taxes. Once delivered, buyers have 72 hours to inspect the item and report issues. Orders are final after rating or automatic completion. Buyer protections and refunds are governed by the Buyer Protection Policy.

 

8. Selling on Ya’Mar. Sellers agree to: Provide accurate descriptions and original photos. Ship items within handling times. Avoid prohibited items. Follow carrier, customs, and tax laws. Communicate with buyers in a timely manner

 

9. Fees & Commissions: Listing is free. Commissions, wholesale rates, QR code discounts, digital product fees, and payment processing charges are listed in the Fees & Commissions Policy. Fees are automatically deducted before seller payout.

 

10. Shipping : Ya’Mar provides prepaid labels for items ≤ 50 lbs. Sellers must enter accurate weight and dimensions. Oversized/heavy items require seller-provided shipping with tracking. Late shipment or no tracking may cause cancellation or penalties. Shipping disputes follow the Refunds & Returns Policy.

 

11. Prohibited Conduct: Users may not: Break any laws or regulations Commit fraud or promote off-platform sales Harass, threaten, or use hate speech Circumvent platform fees Upload viruses or malicious software Operate multiple fraudulent accounts. Promote external businesses on Ya’Mar without approval. Enforcement Actions:Ya’Mar may suspend or close accounts, remove listings, or hold funds up to 180 days for disputes, chargebacks, or investigations.

 

12. Messaging & App Etiquette: Be respectful and professional in messages. No harassment, spam, or discrimination. All communication and transactions must remain on the Ya’Mar platform. Do not send personal contact info or external payment links. Violations may result in messaging restrictions or account suspension.

 

13. Buyer Protection. You are protected if an item is: Not delivered Damaged on arrival Not as described or counterfeit Claims must be filed within 72 hours of delivery and before rating.

 

14. Refunds & Returns: Buyers have 72 hours after delivery to request a return. Items must be returned in original condition. Prepaid return labels may be issued for eligible items. Refunds are processed within the Ya’Mar app after verification.

 

15. Taxes & 1099-K Reporting: Ya’Mar issues IRS Form 1099-K (or equivalent) for qualifying U.S. sellers. Sellers must provide valid tax information. Taxes may be collected and remitted as required by law.

 

16. Account Closure PenaltiesAccounts may be suspended or closed for:Repeated violationsFraud or abuseFailure to verify identity or tax informationFunds may be held for up to 180 days for disputes or legal obligations.

 

17. Requests from Law Enforcement: Ya’Mar complies with valid subpoenas, court orders, and legal data requests according to our Law Enforcement Requests Policy.

 

18. International Shipping: Buyers are responsible for customs duties and import taxes. Sellers must declare the correct value and details for shipments. Illegal or restricted exports/imports may be canceled or seized.

 

19. Intellectual Property & DMCA ComplianceYa’Mar follows the Digital Millennium Copyright Act (DMCA).Copyright claims should be sent to: legal@yamarapp.comCounter-notices are reviewed per U.S. law.

 

20. Limitation of LiabilityYa’Mar is not responsible for:User behavior or third-party actionsLost packages or shipping delaysIndirect, incidental, or consequential damagesOur liability is limited to the total fees paid by you in the last 30 days.

 

21. Dispute Resolution & ArbitrationUsers must attempt to resolve issues through Ya’Mar Support first.Unresolved disputes will be settled by binding arbitration in Florida, USA under the Federal Arbitration Act.Users waive the right to participate in class-action lawsuits.

 

22. Governing LawThese Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.
