Ya’Mar Prohibited Conduct Policy

Effective Date: May 20, 2026

This Prohibited Conduct Policy (“Policy”) is incorporated by reference into the Ya’Mar Terms of Service and applies to all users of the Ya’Mar marketplace application, website, and related services (collectively, the “Platform”).

By accessing or using the Platform, users agree to comply with this Policy and all incorporated Platform Policies. Violations may result in listing removal, reduced visibility, withheld payouts, reserve requirements, transaction freezes, account restrictions, permanent suspension, collections activity, arbitration, legal enforcement, or additional enforcement actions where permitted by law.

Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) is committed to maintaining a safe, trustworthy, lawful, and reliable marketplace environment for buyers, sellers, payment processors, shipping providers, and Platform partners.

Ya’Mar may update this Policy periodically for operational needs, fraud prevention purposes, legal compliance, marketplace integrity, customs compliance, payment processor obligations, security concerns, or Platform protection purposes. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.

1. General Prohibited Conduct

Users may not use the Platform for unlawful, fraudulent, deceptive, abusive, harmful, manipulative, or unauthorized purposes.

Prohibited conduct includes violating applicable local, state, federal, national, or international laws or regulations; promoting unlawful activity; engaging in fraud, deception, predatory conduct, or bad faith behavior; interfering with Platform operations; harming customer trust; damaging Ya’Mar’s reputation; violating payment processor rules; violating card network requirements; violating sanctions laws; violating anti-money laundering requirements; violating customs laws; violating intellectual property laws; or violating any incorporated Platform Policy.

Users may not engage in activity that threatens marketplace integrity, customer experience, operational reliability, fraud prevention systems, payment processor relationships, customs compliance efforts, Platform security, or Platform operations.

2. Content Misuse, Technical Abuse, and Platform Interference

Users may not post, upload, transmit, distribute, or otherwise make available content that is unlawful, defamatory, deceptive, fraudulent, obscene, hateful, threatening, harassing, discriminatory, sexually exploitative, abusive, or otherwise objectionable.

Users may not interfere with, disable, bypass, reverse engineer, disrupt, overload, probe, exploit, damage, manipulate, or compromise any portion of the Platform, technical systems, APIs, operational systems, security systems, fraud prevention systems, moderation systems, recommendation systems, or payment systems except where expressly permitted by law.

The introduction of viruses, malware, spyware, ransomware, malicious code, harmful scripts, unauthorized software, automated exploits, or destructive technologies is strictly prohibited.

Users may not send spam, unsolicited communications, chain messages, unauthorized advertisements, phishing attempts, or deceptive communications through the Platform.

Users may not use bots, crawlers, scraping systems, automated monitoring systems, automated purchasing tools, AI agents, machine learning systems, dataset generation systems, data mining systems, automated extraction systems, or similar technologies to access, monitor, collect, harvest, reproduce, scrape, train artificial intelligence systems on, commercially exploit, or otherwise use Platform content, listings, images, marketplace data, descriptions, branding materials, reviews, or user-generated content without prior written authorization from Ya’Mar.

Unauthorized scraping, automated harvesting, automated monitoring, AI training usage, bulk downloading, or automated abuse may result in IP blocking, account restrictions, permanent bans, arbitration, or legal enforcement.

3. Fraud, Identity Abuse, and Misrepresentation

Users may not impersonate individuals, businesses, brands, organizations, or entities or falsely claim affiliations, partnerships, endorsements, credentials, certifications, or authorization rights.

Users may not provide false, manipulated, incomplete, misleading, fraudulent, or deceptive identity information, tax information, payment information, verification documentation, customs information, shipment information, seller information, or account details.

Unauthorized access to another user’s account or attempts to gain unauthorized access are strictly prohibited.

Users may not manipulate evidence, submit false tracking information, submit false authenticity claims, manipulate transaction history, abuse refunds, abuse disputes, abuse chargebacks, manipulate reviews, coordinate fake engagement, artificially inflate traffic, participate in review rings, manipulate referral systems, farm accounts, or otherwise attempt to manipulate Platform systems or marketplace activity.

4. Transaction Abuse and Marketplace Manipulation

Users may not encourage, facilitate, solicit, or complete off-platform transactions, including off-platform payments, unauthorized payment methods, trades, swaps, exchanges, or transactions intended to bypass Platform protections, payment systems, taxes, fees, dispute systems, customs systems, or fraud prevention systems.

Users may not purchase from their own listings, manipulate pricing, engage in coordinated bidding activity, manipulate auction systems, artificially inflate prices, manipulate demand, manipulate supply, interfere with delivery timelines, or abuse marketplace systems.

Unless expressly authorized by Ya’Mar, shipments must be processed through approved Platform shipping workflows, integrations, or authorized fulfillment systems.

Users may not manipulate customs declarations, falsify shipping information, misuse shipping labels, reroute shipments deceptively, evade taxes or duties, undervalue shipments, abuse carrier systems, falsify tracking events, violate sanctions restrictions, or violate import/export laws or customs regulations.

Users may not use unreliable, deceptive, unauthorized, excessively delayed, high-risk, or unapproved fulfillment methods, inventory sources, suppliers, warehouses, or shipping practices that negatively impact delivery performance, tracking reliability, dispute rates, customer satisfaction, fraud prevention systems, operational reliability, or marketplace integrity.

Unapproved payment arrangements including partial payments, future-dated transactions, delayed shipment schemes, unauthorized escrow arrangements, or payment-on-delivery arrangements are prohibited unless expressly authorized by Ya’Mar.

5. Account Abuse and Listing Manipulation

Users may not operate multiple accounts to evade enforcement actions, restrictions, reserves, verification requirements, dispute history, or Platform limitations.

Users whose accounts have been suspended or terminated may not create replacement accounts or access the Platform through unauthorized methods.

Listings must accurately reflect inventory that the seller lawfully possesses or is authorized to sell.

Users may not create misleading listings, spam listings, duplicate listings, deceptive listings, fake listings, manipulated listings, keyword-stuffed listings, irrelevant category placements, false brand references, misleading descriptions, or listings containing unauthorized images or copyrighted materials.

The misuse of stock photos, unauthorized use of third-party images, manipulated authenticity materials, deceptive branding, false advertising claims, or deceptive representations regarding item condition, sourcing, availability, authenticity, or legality is prohibited.

6. Solicitation, External Promotion, and Unauthorized Communications

Users may not solicit users to external websites, external applications, social media platforms, messaging applications, payment systems, or off-platform communication methods for purposes of completing transactions outside the Platform.

Users may not request or pressure buyers for ratings, reviews, testimonials, or endorsements before delivery or before transactions are fully completed.

Users may not collect, harvest, or misuse personal information outside approved Platform workflows.

Unauthorized marketing campaigns, deceptive promotional activity, fake engagement activity, referral abuse, coordinated solicitation campaigns, or unauthorized commercial activity through Platform systems are prohibited.

7. Harassment, Abuse, and Intellectual Property Violations

Harassment, bullying, threats, intimidation, stalking, hate speech, discriminatory conduct, trolling, abusive conduct, defamatory statements, false accusations, malicious reporting, doxxing, impersonation, or dissemination of knowingly false or misleading information is prohibited.

Users may not infringe copyrights, trademarks, patents, publicity rights, privacy rights, licensing rights, or other intellectual property rights.

Counterfeit goods, pirated digital content, unauthorized branded inventory, replica products, stolen goods, manipulated authenticity materials, or infringing inventory are prohibited under the Ya’Mar Authenticity & Anti-Counterfeit Policy and Copyright & DMCA Policy.

Users additionally may not abuse promotions, incentives, referral systems, discounts, credits, coupons, loyalty programs, refunds, or Platform protections in bad faith.

8. Enforcement, Investigations, and Remedies

To the fullest extent permitted by law, Ya’Mar reserves the right to investigate suspected violations and take enforcement action at Ya’Mar’s reasonable discretion based on available evidence, fraud prevention concerns, legal compliance obligations, operational risks, security concerns, customs compliance concerns, payment processor requirements, or marketplace integrity considerations.

Enforcement actions may include listing removal, listing suppression, reduced visibility, restricted functionality, reserve requirements, payout holds, frozen funds, transaction reversals, account restrictions, category restrictions, device restrictions, IP blocking, permanent suspension, referral to collections agencies, arbitration, legal enforcement, customs reporting, cooperation with payment processors, cooperation with financial institutions, cooperation with shipping providers, cooperation with regulators, or referral to law enforcement agencies.

Ya’Mar may preserve transaction records, uploaded content, communications, payment records, shipping records, customs information, device information, IP logs, operational records, technical records, account activity, fraud indicators, or related evidence for fraud prevention, investigations, dispute handling, customs compliance, arbitration, legal enforcement, regulatory compliance, payment processor reviews, Platform security, or law enforcement cooperation purposes.

Repeated violations, counterfeit activity, coordinated abuse, fraud, payment abuse, intellectual property violations, operational threats, customs abuse, dispute abuse, or Platform manipulation may result in permanent bans and prohibition from future use of the Platform.

9. Relationship to Other Policies

This Policy operates together with the Ya’Mar Terms of Service, Privacy Policy, Seller Standards Policy, Authenticity & Anti-Counterfeit Policy, Copyright & DMCA Policy, International Shipping Policy, Returns & Refund Policy, Community Guidelines, Seller Verification & Transparency Policy, and all other incorporated Platform Policies.

In the event of conflict, the Terms of Service govern to the fullest extent permitted by law.
