Ya’Mar Authenticity & Anti-Counterfeit Policy

Effective Date: May 20, 2026

This Authenticity & Anti-Counterfeit Policy (“Policy”) is incorporated by reference into the Ya’Mar Terms of Service and applies to all users of the Ya’Mar marketplace application, website, and related services (collectively, the “Platform”).

Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) is committed to maintaining a trustworthy marketplace where buyers can purchase items with confidence and sellers can conduct business fairly and lawfully.

This Policy governs authenticity requirements, counterfeit prevention standards, seller verification cooperation, buyer protections, authenticity-related investigations, intellectual property compliance efforts, and enforcement actions relating to allegedly counterfeit, replica, unauthorized, stolen, materially misrepresented, or otherwise prohibited inventory.

Ya’Mar may update this Policy periodically for legal compliance, operational needs, fraud prevention efforts, intellectual property protection, customs compliance, marketplace integrity, security concerns, payment processor requirements, or Platform protection purposes. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.

1. Authenticity Requirement

All items listed, sold, promoted, displayed, or distributed through the Platform must be genuine, authentic, lawfully sourced, and accurately represented.

Counterfeit goods, replicas, pirated products, unauthorized reproductions, fake designer goods, unauthorized branded inventory, imitation products, manipulated authentication materials, stolen inventory, or items intended to deceptively resemble authentic branded merchandise are strictly prohibited.

Listings may not contain misleading, deceptive, vague, manipulated, or ambiguous language implying authenticity where authenticity cannot be reasonably verified. Phrases such as “looks authentic,” “might be real,” “replica inspired,” “mirror copy,” “AAA quality,” “unauthorized authentic,” or similar wording may result in listing review, suppression, removal, or enforcement action.

Sellers remain solely responsible for the authenticity, legality, sourcing, import/export compliance, intellectual property compliance, safety, and accuracy of all listed inventory.

2. No Guarantee of Authentication

Unless expressly stated otherwise in writing by Ya’Mar, Ya’Mar does not independently authenticate, certify, appraise, inspect, verify, guarantee, or warrant the authenticity, legality, condition, quality, origin, or safety of items listed on the Platform.

Any moderation action, verification request, listing approval, seller review, account review, authenticity review, enforcement action, automated review, or investigation conducted by Ya’Mar does not constitute a certification, guarantee, appraisal, or representation that an item is authentic, lawful, safe, or accurately described.

Sellers remain solely responsible for proving authenticity and complying with applicable intellectual property laws, customs laws, consumer protection laws, and Platform Policies.

3. Proof of Authenticity and Verification Requests

If Ya’Mar suspects an item may be counterfeit, unauthorized, materially misrepresented, unlawfully sourced, or otherwise noncompliant, Ya’Mar may request additional documentation, information, photographs, or verification materials from the seller.

Verification materials may include purchase receipts, invoices, serial numbers, model numbers, date codes, authenticity certificates, manufacturer tags, original packaging, sourcing documentation, proof of ownership, customs records, supplier records, additional photographs, close-up images, or other identifying materials reasonably necessary for review.

Sellers are required to cooperate fully and promptly with authenticity investigations, fraud prevention reviews, customs-related reviews, intellectual property investigations, dispute investigations, payment processor reviews, or compliance requests.

Failure to provide sufficient proof of authenticity or failure to cooperate with verification efforts may result in listing removal, listing suppression, denied seller protections, withheld payouts, reversed transactions, frozen funds, restricted visibility, reserve requirements, account restrictions, permanent suspension, or additional enforcement action.

Ya’Mar may use automated systems, AI-assisted moderation systems, image comparison technologies, machine learning systems, fraud detection systems, behavioral analysis systems, and risk-scoring technologies to detect suspicious listings, manipulated images, counterfeit indicators, intellectual property abuse, fraudulent behavior, unauthorized branding activity, or violations of Platform Policies.

Certain moderation or enforcement decisions may involve automated systems.

4. Determination of Inauthentic or Prohibited Items

If an item is reasonably believed to be counterfeit, unauthorized, unlawfully sourced, materially misrepresented, prohibited, stolen, or otherwise noncompliant, Ya’Mar may remove the listing and take appropriate enforcement action.

Transactions involving allegedly counterfeit or materially misrepresented inventory may qualify as “not as described” under the Ya’Mar Buyer Protection Policy.

Ya’Mar may withhold payouts, reverse transactions, freeze funds, restrict account functionality, suppress listings, prohibit future listings, deny seller protections, impose reserves, terminate accounts, refer matters to payment processors, cooperate with rights holders, cooperate with customs authorities, cooperate with law enforcement agencies, or pursue additional enforcement action where reasonably necessary for fraud prevention, marketplace integrity, legal compliance, intellectual property protection, operational protection, or consumer protection purposes.

Where permitted by law, Ya’Mar reserves the right to prohibit the return, resale, redistribution, shipment, export, import, or relisting of items reasonably believed to be counterfeit, unlawful, unsafe, stolen, prohibited, or materially misrepresented.

Such inventory may be permanently removed from commerce, surrendered to authorities, destroyed, retained as evidence, or otherwise handled in accordance with applicable law, payment processor requirements, customs obligations, intellectual property obligations, Platform Policies, fraud prevention procedures, or law enforcement requests.

Ya’Mar is not responsible for customs seizures, carrier confiscations, border inspections, trademark enforcement actions, import/export restrictions, governmental actions, or regulatory enforcement involving allegedly counterfeit, prohibited, restricted, or unauthorized inventory.

Users remain solely responsible for compliance with customs laws, sanctions laws, import/export restrictions, intellectual property laws, consumer protection laws, and trade regulations applicable to their transactions.

5. Seller Responsibilities

Sellers are solely responsible for ensuring that all inventory listed through the Platform is genuine, lawful, accurately described, legally sourced, and compliant with applicable laws and Platform Policies.

Sellers must cooperate with authenticity investigations, provide requested verification materials, maintain accurate listings, promptly update inaccurate information, comply with intellectual property laws, comply with customs obligations, maintain lawful sourcing practices, and refrain from relisting removed inventory unless expressly authorized by Ya’Mar.

Sellers additionally remain responsible for supplier conduct, sourcing practices, fulfillment methods, customs compliance, shipping compliance, intellectual property compliance, and operational reliability associated with listed inventory.

Ya’Mar reserves the right to remove, suppress, restrict, disable, limit visibility of, or prohibit listings, sellers, brands, inventory sources, fulfillment methods, categories, or transactions that negatively impact customer trust, marketplace integrity, operational reliability, fraud prevention systems, payment processor obligations, Platform reputation, intellectual property compliance efforts, or customer experience.

Repeated authenticity violations, counterfeit activity, fraudulent verification submissions, replica sales, intellectual property abuse, or unauthorized branded inventory activity may result in permanent Platform bans, collections activity, arbitration, or legal enforcement where permitted by law.

6. Buyer Protections and Buyer Responsibility

Buyers who purchase items later determined to be counterfeit, materially misrepresented, unauthorized, or prohibited may be eligible to submit claims under the Ya’Mar Buyer Protection Policy, subject to applicable requirements, limitations, investigation procedures, evidence requirements, timelines, and eligibility standards.

Where reasonably necessary, buyers may be required to provide photographs, return evidence, carrier documentation, customs documentation, authentication materials, or other supporting evidence during claim investigations.

Buyers may also be required to return items where permitted by law and where reasonably necessary to resolve disputes, preserve evidence, support investigations, comply with payment processor obligations, or comply with legal requirements.

Buyers are encouraged to conduct reasonable due diligence before purchasing high-value, collectible, luxury, branded, limited-edition, or frequently counterfeited items.

Reasonable due diligence may include reviewing listing descriptions carefully, reviewing photographs, reviewing seller ratings, requesting additional information, asking questions through Platform messaging systems, requesting additional verification materials, reviewing seller transaction history, or evaluating seller disclosures.

Failure to review listing disclosures, obvious listing information, authenticity disclaimers, seller communications, or available transaction details prior to purchase may impact Buyer Protection determinations where permitted by law.

This Policy does not relieve sellers of their obligation to list only authentic inventory or provide proof of authenticity when requested.

7. Evidence Preservation and Investigations

Ya’Mar may preserve transaction records, communications, uploaded content, payment records, shipping information, tracking information, photographs, verification materials, IP logs, device information, operational records, customs-related information, account activity, listing history, fraud indicators, dispute records, technical evidence, or related materials for fraud prevention, dispute handling, intellectual property investigations, arbitration, legal enforcement, regulatory compliance, customs compliance, payment processor reviews, Platform security, litigation preservation, or law enforcement cooperation purposes.

Ya’Mar reserves the right to investigate suspicious activity, manipulated evidence, fraudulent verification materials, coordinated counterfeit operations, repeat authenticity violations, suspicious sourcing activity, unauthorized branded inventory, intellectual property abuse, or operational threats affecting marketplace integrity.

8. Enforcement and Consequences

Violation of this Policy may result in listing removal, listing suppression, reduced visibility, withheld payouts, reversed payouts, denied seller protections, reserve requirements, account restrictions, restricted categories, frozen transactions, permanent suspension, collections activity, arbitration, legal enforcement, law enforcement referral, customs reporting, or permanent Platform bans where permitted by law.

Ya’Mar reserves the right, to the fullest extent permitted by law, to determine appropriate enforcement measures at Ya’Mar’s reasonable discretion based on available evidence, fraud prevention concerns, operational protection needs, intellectual property risks, repeat conduct, marketplace integrity concerns, customer protection considerations, customs concerns, payment processor obligations, or security considerations.

9. Relationship to Other Policies

This Policy operates together with the Ya’Mar Terms of Service, Buyer Protection Policy, Seller Standards Policy, Copyright & DMCA Policy, International Shipping Policy, Prohibited Items Policy, Privacy Policy, Seller Verification & Transparency Policy, and all other incorporated Platform Policies.

In the event of conflict, the Terms of Service govern to the fullest extent permitted by law.
