​Ya’Mar DMCA / Copyright Policy

DMCA Policy Notice

This DMCA / Copyright Policy (“Policy”) is incorporated by reference into the Ya’Mar Terms of Service and applies to all users of the Ya’Mar marketplace application, website, and related services (collectively, the “Platform”).

By accessing or using the Platform, users agree to comply with this Policy, the Terms of Service, and all incorporated Policies.

Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (“DMCA”), applicable copyright laws, trademark laws, counterfeit prevention laws, licensing laws, intellectual property laws, and related legal obligations.

This Policy explains how copyright owners may request removal of allegedly infringing content, how users may submit counter notices, how Ya’Mar handles repeat infringement activity, how Ya’Mar protects marketplace integrity, and how Platform content may be used in connection with Platform operations, advertising, marketing, and promotional activities.

Ya’Mar may update this Policy periodically as required by law, operational needs, fraud prevention concerns, Platform integrity requirements, marketplace protection efforts, security considerations, business operations, or compliance obligations. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.

1. User Responsibility for Intellectual Property and Uploaded Content

Users are solely responsible for ensuring that any content, inventory, digital products, media, branding, listings, materials, descriptions, or files uploaded, posted, listed, sold, displayed, distributed, transmitted, or otherwise made available through the Platform are lawfully owned, licensed, authorized, or permitted for use.

This includes copyrighted works, trademarks, logos, music, audio, software, digital products, graphics, artwork, photographs, videos, written content, marketing materials, downloadable files, product designs, branded goods, and other protected materials.

Uploading, reproducing, distributing, displaying, selling, transmitting, or otherwise using copyrighted or protected material without authorization violates Platform Policies and applicable law.

Ya’Mar prohibits counterfeit goods, unauthorized replicas, pirated digital content, trademark-infringing inventory, unauthorized branded merchandise, stolen intellectual property, manipulated content, and listings that violate copyright, trademark, licensing, or intellectual property rights.

Users remain solely responsible for complying with applicable international copyright laws, trademark laws, import/export restrictions, licensing obligations, intellectual property regulations, consumer protection laws, and digital content laws applicable to their jurisdiction, inventory, listings, or transactions.

By uploading, posting, listing, displaying, transmitting, submitting, or distributing content through the Platform, including listings, usernames, shop names, logos, descriptions, reviews, photos, videos, product information, branding materials, and other user-generated content, users grant Ya’Mar LLC a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify for formatting purposes, adapt for technical purposes, publish, translate, process, promote, advertise, market, perform, and otherwise use such content in connection with operating, securing, improving, enforcing, advertising, marketing, promoting, and providing the Platform and related services.

This license includes the right for Ya’Mar LLC to use listings, product images, shop names, usernames, branding elements, descriptions, reviews, and related content in Platform advertising, promotional campaigns, social media marketing, search results, featured listings, email marketing, marketplace showcases, app store materials, recommendation systems, Platform branding, fraud prevention systems, AI-assisted formatting systems, moderation systems, operational systems, and other marketplace-related promotional or operational purposes.

Users represent and warrant that they possess all rights necessary to grant this license.

This license survives account suspension, listing removal, and account termination solely to the extent reasonably necessary for legal compliance, fraud prevention, dispute resolution, archived marketplace functionality, operational records, advertising materials already in circulation, enforcement of agreements, or Platform protection purposes.

2. Copyright Infringement Notices (DMCA Takedown Requests)

If you believe copyrighted material has been uploaded, posted, listed, sold, displayed, distributed, transmitted, or otherwise made available on Ya’Mar without authorization, you may submit a DMCA takedown request by contacting:

To be legally valid under the DMCA, a notice must include identification of the copyrighted work claimed to be infringed, identification of the allegedly infringing material and its location on the Platform, a statement that the complaining party has a good faith belief that the use is unauthorized, a statement under penalty of perjury that the information provided is accurate and that the complaining party is authorized to act on behalf of the copyright owner, along with the complaining party’s legal name, mailing address, email address, phone number, and physical or electronic signature.

Incomplete, inaccurate, abusive, manipulated, misleading, fraudulent, or legally insufficient notices may be delayed, rejected, ignored, or subject to additional review.

Ya’Mar reserves the right to remove or disable allegedly infringing content, suppress listings, preserve evidence, freeze transactions, withhold payouts, restrict visibility, suspend accounts, investigate related activity, cooperate with rights holders, cooperate with payment processors, or take additional enforcement action where reasonably necessary for fraud prevention, legal compliance, marketplace integrity, counterfeit prevention, Platform security, operational protection, or consumer protection purposes.

Ya’Mar may cooperate with payment processors, financial institutions, fraud prevention providers, customs authorities, regulators, arbitrators, law enforcement agencies, marketplaces, rights holders, shipping providers, collection agencies, or legal authorities regarding intellectual property complaints, counterfeit investigations, fraud prevention efforts, payment disputes, or legal compliance matters.

Ya’Mar may preserve transaction records, communications, uploaded files, payment records, listing history, technical logs, IP records, operational records, account activity, device information, dispute records, shipping records, or related evidence for fraud prevention, dispute handling, intellectual property investigations, arbitration, legal enforcement, regulatory compliance, litigation preservation, law enforcement cooperation, customs compliance, or Platform security purposes.

3. Counter Notices (Content Removed in Error)

If content was removed due to a DMCA complaint and the affected user believes removal resulted from mistake, misidentification, authorization, licensing rights, ownership rights, or lawful use, the user may submit a counter notice by contacting:

A valid counter notice must include identification of the removed material and its previous location on the Platform, a statement under penalty of perjury that the user has a good faith belief the content was removed due to mistake or misidentification, consent to jurisdiction in the federal courts located in Florida, United States, agreement to accept service of process from the original complaining party or authorized representative, and the user’s legal name, mailing address, email address, phone number, and physical or electronic signature.

Upon receipt of a legally sufficient counter notice, Ya’Mar may restore the content within approximately ten (10) to fourteen (14) business days unless the original claimant notifies Ya’Mar that legal action has been filed seeking a court order restraining the allegedly infringing activity.

Ya’Mar reserves the right to decline restoration where reasonably necessary for fraud prevention, counterfeit concerns, repeat infringement concerns, Platform integrity, operational protection, legal compliance, security concerns, or violations of Platform Policies.

4. Repeat Infringer and Counterfeit Policy

In accordance with the DMCA and applicable intellectual property laws, Ya’Mar maintains a repeat infringer policy.

Users who repeatedly upload, repost, relist, reproduce, distribute, display, sell, transmit, or otherwise use infringing content, counterfeit goods, unauthorized branded inventory, pirated digital content, replica products, trademark-infringing merchandise, or unauthorized copyrighted materials may be subject to enforcement action.

Ya’Mar may suspend accounts, permanently terminate accounts, remove listings, suppress visibility, freeze transactions, deny seller protections, withhold payouts, impose reserves, restrict Platform access, refer matters to law enforcement, cooperate with rights holders, cooperate with payment processors, pursue collections activity, initiate arbitration, or pursue legal enforcement where permitted by law.

Ya’Mar reserves the right to permanently prohibit users involved in counterfeit activity, intellectual property abuse, repeat trademark infringement, unauthorized branded inventory, fraudulent copyright activity, or repeated Policy violations from future use of the Platform.

To the fullest extent permitted by law, determinations regarding repeat infringement, counterfeit concerns, intellectual property abuse, listing removal, account enforcement, or Platform restrictions are made at Ya’Mar’s reasonable discretion based on available evidence, legal risk, fraud prevention considerations, operational concerns, repeat conduct, marketplace integrity concerns, consumer protection considerations, and Platform security needs.

5. False, Fraudulent, or Abusive Complaints

Users, claimants, reporting parties, or rights holders may not submit knowingly false, abusive, manipulated, fraudulent, retaliatory, misleading, deceptive, bad faith, or unauthorized copyright complaints, trademark complaints, counterfeit reports, or counter notices.

Submitting false notices, manipulated evidence, fraudulent reports, coordinated abuse, deceptive takedown requests, or knowingly inaccurate claims may result in rejection of the complaint, restricted reporting privileges, listing removal, withheld payouts, account restrictions, collections activity, arbitration, permanent suspension, or legal enforcement under applicable law.

Ya’Mar reserves the right to investigate abusive reporting behavior, fraudulent intellectual property claims, manipulated evidence, coordinated reporting abuse, retaliatory complaints, or conduct that threatens marketplace integrity or Platform operations.

6. Unauthorized Copying, Scraping, and AI Training Restrictions

Users may not scrape, harvest, download, reproduce, mirror, republish, archive, distribute, extract, license, commercially exploit, resell, or otherwise use Platform content, listings, images, videos, branding, reviews, marketplace data, descriptions, or user-generated content for unauthorized commercial purposes, dataset generation, artificial intelligence training, machine learning systems, automated harvesting, automated data extraction, or unauthorized operational purposes without prior written authorization from Ya’Mar LLC or the applicable rights holder.

Unauthorized scraping, automated harvesting, bot activity, mass copying, bulk downloading, unauthorized AI training usage, automated collection activity, dataset generation, or technical abuse may result in account restrictions, IP blocking, Platform bans, arbitration, legal enforcement, permanent suspension, or referral to law enforcement where appropriate.

7. No Legal Advice

This Policy is provided for informational purposes only and does not constitute legal advice.

Ya’Mar does not provide legal advice and does not make final legal determinations regarding ownership rights, copyright infringement, trademark infringement, licensing rights, counterfeit status, authenticity determinations, fair use protections, authorization rights, or intellectual property disputes.

Users are encouraged to consult qualified legal counsel regarding intellectual property matters, licensing obligations, trademark concerns, DMCA-related disputes, counterfeit concerns, or copyright enforcement matters.

8. Relationship to Other Policies

This Policy operates together with the Ya’Mar Terms of Service, Privacy Policy, Seller Standards Policy, Seller Verification & Transparency Policy, Returns & Refund Policy, Prohibited Items Policy, Community Guidelines, and all other incorporated Platform Policies.

In the event of conflict, the Terms of Service govern to the fullest extent permitted by law.
