Ya’Mar Shield Buyer Protection Policy

Effective Date: May 20, 2026

This Ya’Mar Shield Protection Policy (“Policy”) is incorporated into the Ya’Mar Terms of Service and applies to all users of the Ya’Mar Marketplace application, website, and related services (collectively, the “Platform”).

By accessing or using the Platform, users agree to comply with this Policy and all incorporated Terms and Policies.

Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) may update this Policy periodically for operational needs, fraud prevention purposes, legal compliance, payment processor requirements, marketplace integrity, security concerns, shipping integrations, customs compliance, or Platform protection purposes. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.

1. Purpose of Ya’Mar Shield

Ya’Mar Shield is a limited discretionary Platform protection program intended to help support safer marketplace transactions between buyers and sellers.

Ya’Mar Shield may provide limited reimbursement eligibility, fraud prevention assistance, dispute resolution support, payment review services, transaction monitoring, operational protections, and marketplace security protections for eligible transactions completed through approved Platform systems.

Ya’Mar Shield is not insurance, a banking service, escrow service, fiduciary relationship, product warranty, financial guarantee, authentication guarantee, or substitute for third-party insurance coverage.

Eligibility for Ya’Mar Shield does not guarantee refunds, reimbursements, approvals, favorable dispute outcomes, successful recovery of losses, or claim approval.

Coverage applies only under the conditions expressly described in this Policy.

2. Scope of Coverage

Eligible transactions completed entirely through approved Ya’Mar systems using approved payment methods and approved shipping workflows may qualify for Ya’Mar Shield protections.

Coverage may apply to qualifying issues including orders not received, items significantly not as described, major undisclosed damage, missing major components, proven counterfeit items, certain unauthorized transaction disputes, certain fraudulent seller activity, and certain fraudulent buyer activity.

Transactions occurring partially or entirely outside the Platform, including off-platform payments, unauthorized shipping methods, or attempts to bypass Platform systems, are generally not eligible for protection.

Coverage eligibility generally requires use of:

  • Approved in-app payment systems

  • Approved payment processors

  • Approved shipping workflows

  • Approved carrier tracking systems

Ya’Mar reserves the right, to the fullest extent permitted by law, to determine eligibility at Ya’Mar’s reasonable discretion based on available evidence, fraud prevention considerations, operational concerns, Platform Policies, payment processor obligations, customs compliance concerns, and applicable law.

3. Ya’Mar Shield Fees

Ya’Mar may charge a Ya’Mar Shield fee on eligible transactions to support fraud prevention systems, payment security, dispute handling, operational protections, customer support, transaction monitoring, security systems, and marketplace integrity protections.

Applicable fees will be disclosed before checkout where required.

Ya’Mar Shield fees are generally non-refundable once payment has been processed except where required by law or where a transaction is fully canceled by Ya’Mar.

4. Payment Processing, Holds, and Transaction Reviews

Payments, refunds, holds, reversals, reserves, and payouts are processed through third-party payment processors including Stripe and affiliated providers using encrypted systems.

Buyer payments may be temporarily held until delivery is confirmed, review periods expire, disputes are resolved, fraud reviews are completed, customs reviews are completed, or operational concerns are resolved.

Buyers generally have seventy-two (72) hours after confirmed delivery to report eligible issues through approved Platform systems unless otherwise required by law.

If no issue is reported during the applicable review period, funds may be released to the seller and the transaction may be considered completed.

Ya’Mar may temporarily hold funds, reverse payouts, delay payouts, freeze transactions, restrict account access, impose reserves, require additional verification, or restrict Platform functionality where reasonably necessary for disputes, fraud prevention, chargeback handling, customs compliance, payment processor obligations, legal compliance, investigations, operational protection, security concerns, or marketplace integrity purposes.

Ya’Mar does not directly hold user funds and does not act as a bank, money transmitter, insurer, or fiduciary.

5. Eligibility Requirements

To qualify for Ya’Mar Shield protections, buyers must complete transactions entirely through approved Platform systems, use approved payment methods, report issues within required timelines, provide truthful supporting evidence, communicate through approved Platform channels, and comply with Platform Policies.

Sellers must ship through approved Platform shipping workflows, use approved carrier partners, provide valid tracking information generated through approved systems, ship within required handling timelines, maintain accurate listings, cooperate during investigations, comply with customs obligations, and maintain accounts in good standing.

Transactions involving prohibited items, fraudulent activity, unauthorized off-platform activity, customs violations, manipulated evidence, unauthorized fulfillment methods, or attempts to bypass Platform protections may be denied coverage. Claims arising primarily from customs assessments, customs duties, import taxes, brokerage fees, governmental assessments, customs processing fees, tariff classifications, HS code disputes, customs valuation disputes, import restrictions, or destination-country regulatory requirements generally do not qualify for Ya'Mar Shield coverage unless otherwise expressly required by law or approved by Ya'Mar.

6. Filing Claims and Supporting Evidence

Eligible users may file claims through approved Platform workflows by opening the applicable order, selecting the appropriate issue type, uploading supporting evidence, and submitting the claim for review.

Supporting evidence may include photographs, videos, tracking information, communications, delivery confirmations, return confirmations, customs documentation, authentication materials, or additional documentation requested by Ya’Mar.

Failure to provide requested information or cooperate during investigations may result in denial of claims or loss of protections.

False, manipulated, misleading, altered, incomplete, abusive, or fraudulent evidence may result in claim denial, withheld payouts, chargeback fees, account restrictions, permanent bans, collections activity, arbitration, or legal enforcement where permitted by law.

Return fraud, item switching, altered returns, empty-box returns, counterfeit return substitutions, intentionally damaged returns, partial returns, or abuse of return systems may result in denial of claims, withheld funds, permanent Platform bans, collections activity, or legal enforcement.

7. Review, Investigation, and Fraud Prevention

Ya’Mar may review transaction records, uploaded evidence, listing descriptions, communications, payment activity, tracking information, account history, dispute history, device information, customs documentation, fraud indicators, technical records, shipping information, and operational records during investigations.

Ya’Mar may use automated systems, AI-assisted moderation systems, fraud detection technologies, machine learning systems, behavioral analysis tools, image analysis systems, risk-scoring technologies, and automated review systems to investigate disputes, evaluate transaction risk, detect suspicious activity, enforce Platform Policies, and protect marketplace integrity.

Certain moderation, fraud prevention, or claim decisions may involve automated systems.

During investigations Ya’Mar may hold funds, reverse transactions, restrict accounts, delay payouts, freeze balances, request additional documentation, require return shipments, provide prepaid return labels, deny claims, cooperate with payment processors, cooperate with shipping providers, cooperate with customs authorities, or refer matters to law enforcement agencies where appropriate.

If a return shipment is required, buyers generally must ship the item within three (3) business days unless otherwise instructed. Returned items must substantially match the condition in which they were originally received unless otherwise permitted by law.

Failure to comply with return instructions or investigation requirements may result in denial of protections.

Ya’Mar reserves the right to remove, suppress, restrict, delay, disable, or prohibit transactions, listings, inventory sources, fulfillment methods, sellers, buyers, accounts, or categories that negatively impact customer trust, customer experience, Platform reputation, operational reliability, payment processor relationships, fraud prevention systems, marketplace integrity, customs compliance efforts, or Platform security.

8. Refunds and Resolutions

If a claim is approved, Ya’Mar may issue full refunds, partial refunds, payout releases, return approvals, account enforcement actions, claim denials, transaction reversals, or other resolutions deemed appropriate under the circumstances.

Refunds are generally issued to the original payment method and may require approximately five (5) to ten (10) business days depending on financial institutions, payment processors, carrier systems, or banking systems.

Digital goods may qualify for protection only where materially defective, inaccessible, corrupted, incomplete, or significantly misrepresented. Other digital sales are generally final unless otherwise required by law.

9. Coverage Limits

Ya'Mar Shield coverage is limited to a maximum reimbursement amount of up to $200 USD per eligible transaction unless otherwise required by law.

Coverage limits apply per transaction and not per item.

Coverage may include eligible portions of the item price, shipping charges, and applicable taxes paid through approved Platform systems.

Coverage generally does not include:

• Ya'Mar Shield fees

• Consequential damages

• Lost profits

• Business interruption losses

• Emotional distress damages

• Attorney fees

• Governmental penalties

• Customs penalties

• Regulatory fines

• Brokerage fees

• Duties, taxes, VAT, GST, customs charges, or governmental assessments that have already been remitted to customs authorities, governmental agencies, carriers, logistics providers, or third-party service providers

Users purchasing high-value inventory acknowledge that additional protection may require third-party insurance coverage.

10. Exclusions and Non-Covered Claims

Ya'Mar Shield generally does not cover buyer remorse, personal preference dissatisfaction, subjective complaints regarding texture, softness, comfort, fit, color tone, appearance, scent, storage odors, smoke smells, perfumes, or similar subjective concerns unless expressly guaranteed within the listing.

Coverage additionally excludes:

• Minor cosmetic imperfections

• Normal wear consistent with used goods

• Disclosed defects

• Visible imperfections shown in listing photos

• Sizing dissatisfaction where measurements were provided

• Manufacturer variations

• Issues caused after confirmed delivery

• Customs delays

• Customs inspections

• Border processing delays

• Carrier delays

• Weather delays

• Labor disputes

• Governmental actions

• Brokerage fees

• Customs duties

• Import taxes

• VAT

• GST

• Customs processing fees

• Governmental assessments

• Currency conversion costs

• Carrier surcharges

• Prohibited items

• Transactions completed outside approved Platform systems

• Claims lacking sufficient evidence

• Fraudulent claims

• Losses exceeding stated coverage limits

Ya'Mar is not responsible for customs seizures, carrier confiscations, border inspections, sanctions enforcement actions, import restrictions, customs holds, customs assessments, governmental actions, or operational disruptions outside Ya'Mar's reasonable control.

For DDP shipments, duties, taxes, VAT, GST, brokerage fees, customs processing fees, and similar import-related charges collected during checkout may be remitted before delivery occurs. Such amounts may not be recoverable and generally are not covered under Ya'Mar Shield.

11. Shipping and Delivery Requirements

Coverage eligibility generally requires shipment through approved Platform shipping systems, approved carrier tracking, accurate package details, timely shipment, and delivery confirmation where applicable.

Shipping labels, carrier integrations, address verification systems, postage calculations, tracking systems, and shipping-related operational services may be facilitated through third-party providers including ShipEngine and affiliated carrier partners.

Ya’Mar is not responsible for carrier outages, shipping software outages, API interruptions, postage calculation errors, customs delays, address verification failures, carrier delays, weather disruptions, labor disputes, or operational failures outside Ya’Mar’s reasonable control.

If tracking information reflects “Delivered” status but a buyer reports non-delivery, the buyer generally must contact Ya’Mar Support within forty-eight (48) hours unless otherwise required by law.

12. Chargebacks and Payment Disputes

Users agree to first attempt dispute resolution through Ya’Mar Shield before initiating chargebacks or payment disputes through financial institutions.

If a chargeback or payment dispute occurs, Ya’Mar may provide transaction records, communications, tracking information, device information, account history, customs documentation, fraud indicators, operational records, or related evidence to payment processors, financial institutions, arbitrators, dispute resolution providers, regulators, customs authorities, or law enforcement agencies where permitted by law.

Ya’Mar reserves the right to assess a $30 USD chargeback administration fee against buyers or sellers determined reasonably responsible for fraudulent conduct, false claims, abusive disputes, duplicate refund attempts, improper chargebacks, Platform abuse, bad-faith disputes, or violations of Platform Policies.

Applicable fees may be deducted from payouts, balances, reserves, refunds, future payouts, payment methods on file, or other amounts owed where permitted by law.

Fraudulent or abusive chargeback activity may result in withheld funds, permanent bans, collections activity, arbitration, legal enforcement, or additional recovery actions.

13. Collections and Recovery Rights

Users remain solely responsible for refunds, chargebacks, reversed transactions, taxes, customs duties, VAT obligations, GST obligations, brokerage fees, insufficient postage charges, dimensional weight adjustments, address correction fees, carrier surcharges, shipping overages, dispute costs, penalties, collections costs, enforcement costs, or other amounts arising from use of the Platform.

Where permitted by law, users authorize Ya’Mar and its payment processors to recover such amounts from payment methods, balances, reserves, payouts, future transactions, linked bank accounts, funding sources, or financial methods associated with the account.

Ya’Mar reserves the right to continue recovery efforts after account suspension, restriction, closure, or termination and may refer unpaid balances to third-party collection agencies, arbitration, credit reporting entities where permitted, or legal enforcement proceedings.

Users remain responsible for all amounts owed even after account closure or termination.

For international transactions, users additionally authorize Ya'Mar and its payment processors to recover customs duties, import taxes, VAT, GST, brokerage fees, customs processing fees, carrier surcharges, customs adjustments, governmental assessments, return shipping costs, penalties, and related amounts arising from inaccurate customs declarations, inaccurate HS codes, inaccurate declared values, inaccurate countries of origin, customs enforcement actions, carrier adjustments, import/export violations, regulatory actions, or other customs-related obligations where permitted by law and applicable Platform Policies.

14. Marketplace Transactions and User Responsibility

Users acknowledge that transactions occur directly between independent buyers and sellers.

Ya’Mar does not manufacture, inspect, authenticate, certify, warehouse, test, store, guarantee, appraise, or control listed items, inventory sources, shipments, or user conduct unless expressly stated otherwise.

To the fullest extent permitted by law, Ya’Mar is not responsible for item quality, listing accuracy, counterfeit goods, odors, wear, sizing issues, user conduct, injuries, transaction disputes, carrier failures, customs delays, third-party services, processor outages, or losses arising from Platform transactions.

Users assume all risks associated with marketplace activity.

15. Disclaimer of Warranties

THE PLATFORM AND YA’MAR SHIELD ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” TO THE FULLEST EXTENT PERMITTED BY LAW.

Ya’Mar DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, CONTINUOUS AVAILABILITY, QUIET ENJOYMENT, AND ERROR-FREE OPERATION.

Ya’Mar does not guarantee listing accuracy, successful dispute outcomes, reimbursement eligibility, item authenticity, favorable resolutions, uninterrupted service, successful delivery outcomes, or error-free Platform operation.

Users use the Platform entirely at their own risk.

16. Limitation of Liability

To the fullest extent permitted by law, Ya’Mar, its affiliates, officers, employees, contractors, licensors, payment processors, shipping providers, and service providers shall not be liable for indirect damages, consequential damages, emotional distress, business interruption, lost profits, data loss, personal injury, shipping failures, customs delays, cyber incidents, user disputes, operational disruptions, or transaction losses.

Ya’Mar’s total cumulative liability relating to the Platform or Ya’Mar Shield shall not exceed the lesser of:

  1. The amount paid to Ya’Mar relating to the transaction giving rise to the claim; or

  2. $200 USD.

Certain jurisdictions may not allow some limitations, so portions of this section may not apply to certain users.

17. Final Determinations

To the fullest extent permitted by law, Ya’Mar Shield determinations are made at Ya’Mar’s reasonable discretion based on available evidence, Platform Policies, payment processor obligations, fraud prevention concerns, operational considerations, customs compliance concerns, legal requirements, and marketplace integrity protections.

18. Survival

Sections relating to payments, collections, recovery rights, arbitration, fraud prevention, dispute handling, liability limitations, taxes, customs obligations, chargebacks, enforcement rights, intellectual property protections, and Platform security survive account suspension, restriction, closure, or termination.

19. Policy Updates

Ya’Mar may modify this Policy periodically for operational, legal, security, fraud prevention, shipping integration, customs compliance, payment processing, or marketplace integrity purposes.

Updated versions become effective upon posting within the Platform or on Ya’Mar’s website. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.
