Ya’Mar Digital Items Policy
Effective Date: May 20, 2026
This Digital Items Policy (“Policy”) is incorporated by reference into the Ya’Mar Terms of Service and applies to all users of the Ya’Mar Marketplace application, website, and related services (collectively, the “Platform”).
By accessing, purchasing, selling, downloading, uploading, licensing, redeeming, or otherwise using digital items through the Platform, users agree to comply with this Policy and all incorporated Terms and Policies.
Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) may update this Policy periodically for operational needs, legal compliance, payment processor requirements, intellectual property protection, fraud prevention efforts, marketplace integrity, Platform security, or evolving digital marketplace functionality. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.
1. Purpose and Scope
This Policy governs the listing, sale, delivery, distribution, refunds, disputes, enforcement, fraud prevention, and use of digital items offered through the Platform.
Digital items may include downloadable files, digital artwork, templates, e-books, digital media, AI-generated content, downloadable graphics, printable materials, digital designs, educational downloads, editable digital products, photography files, and other electronically delivered or non-physical goods approved by Ya’Mar.
The Platform does not support or permit:

activation keys

software licenses

streaming subscriptions

cloud-based memberships

subscription-based digital access

unauthorized account access sales

software access resales

digital products prohibited under Platform Policies
This Policy applies only to digital transactions completed through approved Platform systems.
2. Nature of Digital Transactions
Digital items are electronically delivered and are not physical goods.
Due to the nature of digital delivery, downloads, file access, and electronic distribution, digital item sales are generally final once delivery, download access, or availability has been provided unless otherwise required by law or expressly stated in this Policy.
Buyers acknowledge that digital items may be copied, downloaded, saved, printed, transferred, or consumed immediately after purchase and therefore may not qualify for returns in the same manner as physical goods.
Buyers additionally acknowledge that certain digital items may require compatible devices, software, hardware, updated applications, internet access, printers, design programs, or technical knowledge outside Ya’Mar’s reasonable control.
Ya’Mar does not guarantee continuous, uninterrupted, perpetual, or error-free access to seller-managed files, external download systems, third-party hosting services, cloud systems, APIs, or externally controlled systems outside Ya’Mar’s reasonable control.
3. Seller Responsibilities for Digital Items
Sellers offering digital items are solely responsible for providing accurate, complete, truthful, and non-misleading listing descriptions, file details, compatibility disclosures, permitted usage disclosures, download instructions, and functionality disclosures.
Sellers represent and warrant that they possess all rights, licenses, permissions, authorizations, and legal authority necessary to upload, distribute, promote, sell, or otherwise provide digital content through the Platform.
Sellers may not upload, distribute, promote, or sell:

Pirated content

Counterfeit digital goods

Unauthorized reproductions

Malware
-
Harmful software
-
Stolen digital files
-
Infringing materials
-
Deceptive digital products
-
Manipulated files
-
Unauthorized AI-generated content
-
Prohibited digital content under Platform Policies or applicable law
Failure to comply with seller responsibilities may result in listing removal, listing suppression, withheld payouts, denied Ya’Mar Shield eligibility, payout reversals, reserve requirements, account restrictions, permanent suspension, arbitration, collections activity, legal enforcement, or referral to rights holders, payment processors, regulators, or law enforcement agencies where permitted by law.
4. Delivery and Digital Access
Digital items may be delivered through in-app downloads, downloadable files, secure links, approved external integrations, or other approved delivery mechanisms supported by the Platform.
A digital item is generally considered delivered once access to the file or approved download method becomes available through approved Platform systems.
Buyers remain solely responsible for reviewing listing disclosures, understanding technical requirements, maintaining compatible software or hardware, maintaining internet access, and ensuring the ability to access or use digital items before purchase.
Ya’Mar does not guarantee uninterrupted availability of download systems, seller-managed systems, external hosting systems, APIs, third-party integrations, or externally controlled services outside Ya’Mar’s reasonable control.
5. Refunds and Buyer Protection for Digital Items
Digital item sales are generally final once delivery, download access, or file availability has been provided unless otherwise required by law or where limited Ya’Mar Shield eligibility applies.
Buyer Protection for digital items may apply only in limited situations where the digital item is proven to be materially incomplete, corrupted, inaccessible, materially non-functional, or materially misrepresented compared to the listing description.
Claims based on buyer remorse, accidental purchases, subjective dissatisfaction, personal preference, failure to review listing details, misunderstanding of functionality, device incompatibility, software incompatibility, internet connectivity issues, unsupported programs, unsupported devices, user error, unsupported hardware, unsupported operating systems, or technical limitations outside Ya’Mar’s reasonable control generally do not qualify for refunds.
Any approved reimbursement, refund, credit, or dispute outcome remains subject to Ya’Mar Shield limitations, reimbursement caps, fraud prevention reviews, evidence requirements, payment processor obligations, Platform Policies, operational considerations, and applicable law.
6. Seller Discretion for Digital Refunds
Although digital item sales are generally final, sellers may voluntarily choose to provide refunds, replacements, exchanges, credits, additional support, or discretionary resolutions.
Any seller-offered refund terms, replacement policies, usage limitations, or support terms must be clearly disclosed within the listing at the time of purchase.
Seller-provided refunds or discretionary resolutions do not expand Ya’Mar Shield coverage, modify Platform Policies, alter reimbursement limitations, or limit Ya’Mar’s enforcement rights.
Ya’Mar does not require sellers to provide discretionary refunds for digital items unless otherwise required by law.
7. Seller Protection and Payment Reviews
Seller Protection may apply where sellers accurately describe digital items, properly deliver digital files, comply with Platform requirements, cooperate during investigations, comply with intellectual property laws, and comply with Platform Policies.
Seller Protection generally does not apply where sellers fail to deliver digital items, materially misrepresent content, violate intellectual property rights, engage in deceptive conduct, distribute prohibited content, manipulate evidence, engage in fraud, or otherwise violate Platform Policies.
Payments, refunds, reserves, fraud reviews, payout processing, chargeback reviews, and related financial services may be facilitated through third-party payment processors including Stripe and affiliated service providers.
Ya’Mar reserves the right to hold payouts, reverse payouts, delay payouts, freeze transactions, restrict accounts, impose reserves, deny claims, restrict categories, remove listings, or require additional verification where reasonably necessary for fraud prevention, suspicious activity, excessive disputes, intellectual property concerns, payment processor obligations, legal compliance, operational protection, or marketplace integrity.
To the fullest extent permitted by law, Seller Protection determinations are made at Ya’Mar’s reasonable discretion based on available evidence, operational considerations, fraud prevention concerns, payment processor obligations, and applicable Platform Policies.
8. Intellectual Property and Usage Rights
Digital items may be subject to intellectual property protections, copyright protections, trademark protections, or seller-imposed usage restrictions.
Unless expressly stated otherwise, buyers receive only limited personal usage rights specifically granted within the listing description and do not acquire ownership of underlying intellectual property rights.
Unauthorized copying, redistribution, resale, commercial exploitation, unauthorized sharing, sublicensing, reproduction, digital piracy, unauthorized uploads, unauthorized downloads, password sharing, account sharing, or unlawful redistribution of digital items is prohibited.
Ya’Mar does not independently verify intellectual property ownership rights, licensing rights, authorization rights, or distribution rights relating to digital items and is not responsible for intellectual property disputes, ownership disputes, licensing disputes, or unauthorized conduct by users.
Ya’Mar reserves the right, but not the obligation, to monitor digital listings, uploaded content, communications, download activity, account activity, or user conduct relating to digital items.
9. Disputes, Fraud Prevention, and Enforcement
Ya’Mar may investigate disputes involving non-delivery claims, refund abuse, chargeback abuse, unauthorized access, digital piracy, manipulated evidence, suspicious download activity, counterfeit digital goods, policy circumvention, payment fraud, or other suspicious conduct affecting marketplace integrity.
Ya’Mar may use automated systems, AI-assisted moderation systems, fraud detection technologies, machine learning systems, behavioral analysis tools, risk-scoring systems, operational monitoring systems, image analysis systems, and automated review systems to investigate disputes, review digital transactions, detect suspicious activity, enforce Platform Policies, and protect marketplace integrity.
Certain moderation or enforcement decisions may involve automated systems.
Ya’Mar reserves the right to request supporting evidence, remove listings, suppress listings, restrict accounts, deny claims, reverse payouts, freeze transactions, withhold funds, impose reserves, disable access, limit visibility, preserve evidence, cooperate with payment processors, cooperate with rights holders, cooperate with regulators, cooperate with arbitrators, cooperate with collection agencies, cooperate with law enforcement agencies, or pursue legal enforcement where permitted by law.
Ya’Mar additionally reserves the right to remove, suppress, restrict, disable, limit visibility of, or prohibit digital listings, sellers, downloadable products, digital services, AI-generated content, or digital inventory that negatively impacts customer trust, Platform reputation, operational reliability, fraud prevention systems, payment processor relationships, marketplace integrity, intellectual property compliance efforts, customer experience, or Platform security.
10. Recovery Rights and Collections
Where permitted by law, users authorize Ya’Mar and its payment processors to recover chargebacks, refund reversals, penalties, digital fraud losses, processing adjustments, taxes, fees, dispute costs, collections costs, enforcement costs, or other amounts owed from balances, reserves, payouts, future transactions, linked payment methods, bank accounts, or funding sources associated with the account.
Recovery rights survive account suspension, restriction, chargebacks, disputes, account closure, termination, or attempts to remove payment methods from the Platform.
11. Limitations of Liability
Digital items are offered by independent sellers and not by Ya’Mar.
To the fullest extent permitted by law, Ya’Mar does not guarantee the quality, functionality, legality, compatibility, availability, suitability, accuracy, reliability, security, performance, continuous access, or operational availability of digital items offered through the Platform.
Ya’Mar is not responsible for seller conduct, third-party services, technical failures, hosting outages, API failures, software incompatibility, hardware incompatibility, external integrations, internet failures, data loss, intellectual property disputes, transaction losses, user misuse, or operational failures outside Ya’Mar’s reasonable control.
Ya’Mar’s liability relating to digital item transactions remains limited to the fullest extent permitted by law and remains subject to the Terms of Service, Ya’Mar Shield Policy, and related Platform Policies.
12. Survival
Sections relating to payments, collections, recovery rights, intellectual property, arbitration, fraud prevention, dispute handling, chargebacks, enforcement rights, Platform protections, and liability limitations survive account suspension, restriction, closure, or termination.
13. Policy Updates
Ya’Mar may update this Policy periodically to reflect operational changes, legal requirements, payment processor requirements, fraud prevention measures, intellectual property compliance obligations, technological changes, digital marketplace functionality, or Platform security needs.
Updated versions become effective upon posting within the Platform or on Ya’Mar’s website. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.
