Ya’Mar Trademark & Brand Usage Guidelines

These Trademark & Brand Usage Guidelines (“Guidelines”) explain how the Ya’Mar name, logo, trademarks, branding, screenshots, Platform imagery, and related intellectual property may and may not be used. These Guidelines are incorporated by reference into the Ya’Mar Terms of Service, Intellectual Property & Counterfeit Policy, Copyright & DMCA Policy, Community Guidelines, and other applicable Platform Policies.
The Ya’Mar name, logos, trademarks, service marks, branding elements, trade dress, Platform designs, graphics, interfaces, screenshots, marketing materials, icons, buttons, slogans, marketplace branding, and related intellectual property are owned by Ya’Mar LLC and protected by trademark, copyright, unfair competition, trade dress, and other intellectual property laws in the United States and internationally.
Use of Ya’Mar intellectual property is only permitted as expressly authorized by these Guidelines or through prior written permission from Ya’Mar.
Use of the Ya’Mar Name
Users may reference the Ya’Mar name in plain text solely to accurately describe use of the Platform or participation in the marketplace. Examples may include:

“I sell on Ya’Mar”

“Available on Ya’Mar Marketplace”

“Find my shop on Ya’Mar”
Use of the Ya’Mar name must not falsely imply sponsorship, partnership, affiliation, endorsement, authorization, certification, approval, or official association with Ya’Mar.
When referencing the Platform, the Ya’Mar name should always be written correctly as:

Users may not alter, imitate, stylize, modify, misspell, abbreviate, pluralize, translate, or create confusingly similar variations of the Ya’Mar name, branding, or trademarks.
Use of the Ya’Mar Logo and Branding
The Ya’Mar logo, icons, banners, graphics, branding materials, trade dress, interface elements, and related visual assets may not be used without prior written authorization from Ya’Mar or a separate written trademark license agreement.
Unauthorized use of Ya’Mar branding in advertisements, storefronts, websites, social media accounts, videos, influencer content, marketing materials, presentations, merchandise, promotional materials, or business materials is prohibited.
Use of Ya’Mar intellectual property does not grant ownership rights, trademark rights, branding rights, licensing rights, commercial usage rights, or authorization to represent Ya’Mar.
Use of Screenshots and Platform Imagery
Screenshots, images, recordings, videos, interface captures, listing previews, and other Platform imagery may not be used for commercial purposes, cloned services, misleading advertising, fake endorsements, impersonation, deceptive promotions, counterfeit activity, unauthorized press materials, AI-generated impersonation content, or unauthorized commercial marketing without written permission.
Limited non-commercial screenshot use for commentary, reviews, reporting, tutorials, educational purposes, or lawful fair use may be permitted where such use does not violate applicable law, Platform Policies, intellectual property rights, privacy rights, or rights of third parties.
Ya’Mar reserves the right to determine whether screenshot or imagery usage violates these Guidelines.
Domain Names, Usernames, and Social Media Handles
Users may not register, purchase, sell, advertise, transfer, operate, or use:

Domain names containing “Ya’Mar” or confusingly similar variations

Social media handles containing “Ya’Mar” or confusingly similar variations
-
Usernames, storefront names, business names, or branding materials falsely suggesting association with Ya’Mar
-
Fake customer support accounts, fake ambassador accounts, fake affiliate accounts, or impersonation accounts
-
Websites, applications, services, or interfaces designed to imitate, resemble, clone, or falsely appear affiliated with Ya’Mar
Unauthorized impersonation, misleading branding, phishing activity, cloned services, counterfeit branding, or deceptive use of Ya’Mar intellectual property is strictly prohibited.
Prohibited Uses of Ya’Mar Intellectual Property
Ya’Mar does not permit use of its trademarks, branding, screenshots, Platform imagery, or intellectual property for:

Business cards implying official affiliation

Unauthorized advertisements or sponsorships

Fake endorsements or testimonials

Counterfeit or replica products

Misleading affiliate promotions

Deceptive SEO or keyword manipulation

Fake support communications

Impersonation accounts

Fraudulent or misleading marketplace listings

Domain sales involving Ya’Mar branding

Unauthorized merchandise
-
Cloned apps, websites, or interfaces
-
Misleading AI-generated or manipulated content
-
Scam, phishing, fraudulent, or deceptive activity
-
Unauthorized use of screenshots for commercial exploitation
-
Unauthorized branding in books, conferences, sponsorships, courses, or commercial products
Affiliate, Influencer, and Media Use
Approved influencers, affiliates, ambassadors, creators, marketing partners, press organizations, or promotional partners may receive limited written authorization to use certain Ya’Mar branding materials subject to separate agreements, partnership terms, affiliate terms, media guidelines, or written authorization from Ya’Mar.
Unless expressly authorized in writing, users may not represent themselves as official Ya’Mar representatives, employees, agents, affiliates, ambassadors, moderators, customer support representatives, or business partners.
Intellectual Property Enforcement
Ya’Mar reserves the right, at its sole discretion and where permitted by law, to remove, disable, suppress, investigate, demonetize, restrict, report, or take enforcement action against listings, advertisements, domains, usernames, storefronts, content, branding materials, or accounts that violate these Guidelines or applicable intellectual property laws.
Enforcement actions may include:

Removal of content or listings

Username or storefront changes
-
Restriction of marketplace functionality
-
Removal of unauthorized branding
-
Suspension or termination of accounts
-
Reporting violations to domain registrars, social media platforms, payment processors, search engines, app marketplaces, advertising networks, customs authorities, regulators, or law enforcement agencies

Pursuit of legal remedies where appropriate
Repeat violations or intentional misuse of Ya’Mar intellectual property may result in permanent account termination and additional legal action where permitted by law.
Reservation of Rights
Ya’Mar reserves all intellectual property rights, trademark rights, branding rights, copyright rights, trade dress rights, goodwill rights, proprietary rights, and enforcement rights not expressly granted under these Guidelines.
Nothing in these Guidelines transfers ownership of Ya’Mar intellectual property to users or third parties.
Permission Requests
Written permission may be required for:

Use of the Ya’Mar logo

Commercial use of screenshots or Platform imagery

Sponsorships or event partnerships
-
Merchandise or promotional products
-
Books, media projects, educational materials, or conferences

Affiliate campaigns or advertising campaigns

Press or commercial branding requests
Ya’Mar reserves the right to approve, deny, revoke, limit, or modify permissions at its sole discretion.
Policy Updates
Ya’Mar may update these Guidelines at any time to reflect changes in branding, marketplace operations, legal requirements, enforcement practices, fraud prevention systems, intellectual property protections, advertising practices, or business operations.
Continued use of the Platform after updates take effect constitutes acceptance of the revised Guidelines.
