Restricted / Prohibited Items Policy

This Restricted & Prohibited Items Policy (“Policy”) is incorporated by reference into the Ya’Mar Terms of Service and applies to all users of the Ya’Mar Marketplace application, website, and related services (collectively, the “Platform”).
By listing, advertising, promoting, purchasing, shipping, selling, importing, exporting, bidding on, or otherwise interacting with inventory through the Platform, users agree to comply with this Policy and all incorporated Terms and Policies.
Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) may update this Policy periodically for operational needs, payment processor requirements, marketplace integrity, fraud prevention, customs compliance, legal compliance, shipping restrictions, safety concerns, or Platform security purposes. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.
1. Purpose of This Policy
This Policy identifies categories of inventory, products, services, materials, content, or transactions that are restricted, prohibited, regulated, high-risk, unsafe, unlawful, or otherwise not permitted on the Platform.
Certain items may be prohibited entirely, while other items may be restricted based on:

Users remain solely responsible for ensuring compliance with all applicable laws, regulations, customs obligations, import/export restrictions, sanctions laws, licensing requirements, and Platform Policies associated with items listed or sold through the Platform.
2. General Prohibited Items
Users may not list, advertise, promote, sell, distribute, ship, purchase, import, export, or otherwise transact in items that are unlawful, dangerous, deceptive, infringing, harmful, stolen, counterfeit, regulated, or prohibited under applicable law or Platform Policies.

Ya’Mar reserves the right to prohibit additional categories of inventory at any time for operational protection, legal compliance, fraud prevention, safety concerns, payment processor requirements, marketplace integrity, customs compliance, or Platform security purposes.
3. Weapons, Dangerous Items, and Hazardous Materials
The Platform does not permit listings involving:

Items that create elevated safety risks, carrier restrictions, customs risks, legal risks, or operational risks may also be prohibited even if legal in certain jurisdictions.
Users remain solely responsible for complying with all local, state, federal, national, and international restrictions relating to regulated products.
4. Drugs, Controlled Substances, and Medical Products
Users may not list or sell:

Products violating pharmaceutical or healthcare regulations
Certain over-the-counter health products, wellness products, supplements, beauty products, or personal care products may additionally be restricted depending on applicable law, shipping restrictions, payment processor requirements, safety concerns, or regulatory requirements.
5. Counterfeit, Infringing, and Unauthorized Goods
Counterfeit goods, unauthorized branded inventory, pirated digital content, replica products marketed deceptively, manipulated authenticity materials, or infringing products are strictly prohibited.
Users may not infringe copyrights, trademarks, patents, publicity rights, licensing rights, or other intellectual property rights.
Ya’Mar reserves the right to remove listings, preserve evidence, restrict sellers, hold payouts, cooperate with rights holders, cooperate with payment processors, cooperate with customs authorities, cooperate with regulators, cooperate with law enforcement agencies, or pursue legal enforcement where reasonably necessary for intellectual property protection, fraud prevention, marketplace integrity, or legal compliance.
6. Adult Content and Exploitative Material
Users may not list, distribute, promote, or sell:

Non-consensual content

Sexual exploitation materials

Child sexual abuse material

Obscene content prohibited by law

Exploitative services

Content violating human rights laws

Ya’Mar maintains zero tolerance for child exploitation, trafficking-related materials, or unlawful exploitative conduct.
Violations may be reported to law enforcement agencies, child protection organizations, regulators, payment processors, customs authorities, or other appropriate authorities.
7. Financial, Fraudulent, and Deceptive Products
Users may not list or sell:

Ya’Mar additionally prohibits inventory or services intended to facilitate fraud, cybercrime, identity theft, scams, payment abuse, account takeovers, or unlawful financial activity.

Digital products remain subject to the Ya’Mar Digital Items Policy and all incorporated Platform Policies.
9. Animals, Wildlife, and Environmental Restrictions
Users may not list or sell:

Live animals prohibited by law

Endangered species

Illegal wildlife products

Ivory products prohibited by law

Protected animal parts
-
Restricted plants
-
Illegal agricultural products

Products violating environmental protection laws

Items prohibited under wildlife trafficking laws
Users remain solely responsible for complying with wildlife laws, environmental laws, agricultural restrictions, customs laws, and international trade restrictions.
10. Recalled, Unsafe, or High-Risk Consumer Products
Products subject to government recalls, safety recalls, regulatory bans, mandatory warnings, hazardous defects, or consumer safety restrictions may be prohibited from sale through the Platform.
Ya’Mar reserves the right to remove products considered unsafe, defective, misleading, operationally risky, excessively dangerous, high-liability, or otherwise inappropriate for marketplace sale.
11. International Restrictions and Customs Compliance
Certain items may be prohibited due to:

Shipping regulations
International transactions remain subject to the International Shipping Policy and applicable customs laws.
Users remain solely responsible for understanding and complying with all import/export obligations, sanctions laws, customs requirements, licensing requirements, carrier restrictions, and international trade laws associated with their transactions.
12. Marketplace Risk and Operational Restrictions
Ya’Mar reserves the right to prohibit, suppress, restrict, remove, disable, limit visibility of, reject, or prevent listings, categories, inventory sources, sellers, fulfillment methods, or transactions that negatively impact:

Operational reliability

Items may be restricted or removed even where legal in certain jurisdictions if Ya’Mar determines the activity creates elevated operational, legal, reputational, financial, fraud-related, shipping-related, customs-related, or security-related risks.
13. Monitoring, Investigations, and Automated Systems
Ya’Mar may monitor listings, images, descriptions, uploads, account behavior, transaction activity, inventory sources, communications, dispute history, shipping activity, customs information, fraud indicators, and technical activity to enforce this Policy and protect marketplace integrity.
Ya’Mar may use automated systems, AI-assisted moderation systems, machine learning systems, image analysis systems, behavioral analysis tools, fraud detection technologies, operational monitoring systems, and risk-scoring systems to identify prohibited inventory, suspicious activity, counterfeit concerns, policy violations, operational risks, or security threats.
Certain moderation, fraud prevention, dispute handling, listing review, or enforcement decisions may involve automated systems.
Ya’Mar reserves the right, but not the obligation, to investigate suspicious conduct, preserve evidence, cooperate with rights holders, cooperate with payment processors, cooperate with customs authorities, cooperate with regulators, cooperate with shipping providers, cooperate with collection agencies, cooperate with law enforcement agencies, or pursue legal enforcement where reasonably necessary for Platform protection or legal compliance.

Violations of this Policy may result in:

Ya’Mar reserves the right to determine appropriate enforcement actions at Ya’Mar’s reasonable discretion based on available evidence, fraud prevention considerations, operational concerns, payment processor obligations, customs compliance requirements, marketplace integrity protections, Platform security, and applicable law.
15. Limitation of Liability
To the fullest extent permitted by law, Ya’Mar is not responsible for losses arising from user conduct, unlawful inventory, counterfeit products, customs seizures, shipping restrictions, regulatory enforcement, intellectual property disputes, government actions, international trade restrictions, operational restrictions, payment processor restrictions, or enforcement actions taken under this Policy.
Users remain solely responsible for the legality, safety, sourcing, authenticity, shipment eligibility, and regulatory compliance of items associated with their Platform activity.
16. Survival
Sections relating to payments, collections activity, customs obligations, fraud prevention, intellectual property enforcement, dispute handling, arbitration, recovery rights, liability limitations, enforcement rights, and Platform protections survive account suspension, restriction, closure, or termination.
17. Policy Updates
Ya’Mar may update this Policy periodically for operational changes, legal developments, shipping restrictions, customs compliance obligations, fraud prevention measures, marketplace integrity protections, payment processor requirements, or Platform security purposes.
Updated versions become effective upon posting within the Platform or on Ya’Mar’s website. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.
