Ya’Mar Intellectual Property & Counterfeit Policy
Effective Date: October 14, 2025
This Intellectual Property & Counterfeit Policy ("Policy") is incorporated by reference into the Ya’Mar Terms of Service, Copyright & DMCA Policy, Trademark & Brand Usage Guidelines, Prohibited Conduct Policy, Restricted & Prohibited Items Policy, Seller Standards Policy, Account Closure & Penalties Policy, and all other applicable Ya’Mar Policies.
Ya’Mar respects intellectual property rights and is committed to maintaining a marketplace that promotes lawful commerce, authentic products, and respect for the rights of creators, brands, businesses, and intellectual property owners. Sellers are solely responsible for ensuring that items, content, listings, images, branding, digital products, and materials offered through the Platform comply with applicable intellectual property laws and do not infringe the rights of others.
Intellectual Property Rights
Intellectual property rights may include copyrights, trademarks, service marks, trade dress, patents, publicity rights, design rights, proprietary rights, licensing rights, distribution rights, and other legal protections recognized under applicable law.
Users may not list, upload, distribute, sell, advertise, promote, transmit, display, or otherwise make available any item, content, material, or product that infringes or violates the intellectual property rights of another person, business, brand, creator, organization, or rights holder.
Counterfeit and Infringing Products
Counterfeit products are strictly prohibited on Ya’Mar.
Counterfeit products may include items that imitate, copy, replicate, or falsely represent another brand, designer, manufacturer, creator, or rights holder without authorization.
Examples of prohibited counterfeit or infringing items include:

Fake designer handbags, wallets, shoes, clothing, jewelry, or accessories

Unauthorized replicas or knockoffs

Counterfeit luxury goods

Products bearing unauthorized logos or trademarks

Fake branded electronics

Unauthorized branded packaging

Fake authentication certificates

Products falsely represented as authentic

Unauthorized reproductions of branded merchandise

Items falsely advertised as genuine, official, licensed, or authentic
Listings that contain counterfeit, replica, imitation, fake, unauthorized, or misleading products may be removed immediately.
Trademark Violations
Users may not use trademarks, service marks, trade names, logos, slogans, branding, product names, packaging, trade dress, or other protected brand identifiers without authorization.
Users may not:

Misrepresent affiliation with a brand

Falsely claim authorization or certification

Use protected logos without permission

Create misleading listings that imply sponsorship or endorsement

Use brand names in a deceptive or misleading manner

Sell products that infringe trademark rights
Use of a brand name solely to accurately describe a lawful product may be permitted where allowed by applicable law.
Copyright Violations
Users may not upload, sell, distribute, reproduce, copy, display, transmit, or share copyrighted materials without authorization from the copyright owner.

Copied listing images

Unauthorized artwork

Pirated eBooks

Unauthorized PDFs

Stolen digital templates

Copyrighted videos

Copyrighted music

Copyright complaints are handled in accordance with the Ya’Mar Copyright & DMCA Policy.
Digital Products and Licensing Rights
Sellers offering digital products are solely responsible for ensuring they possess all necessary ownership rights, licenses, permissions, commercial use rights, resale rights, distribution rights, or other legal authorization required to offer the product for sale.
Examples of digital products requiring appropriate rights may include:

eBooks
-
Educational materials
-
Workbooks
-
Fonts
-
Music
-
Beats
-
Sound effects
-
Videos

Stock photography

Graphics

Digital artwork

Unauthorized resale, redistribution, duplication, sharing, licensing, sublicensing, or commercialization of protected digital content is prohibited.
Seller Responsibility
Sellers are solely responsible for ensuring that:

Listings are accurate
-
Images are lawfully used
-
Content does not infringe intellectual property rights

Products are legally sourced
-
Digital items are properly licensed
-
Branding is lawfully used
-
Required permissions have been obtained
Ya’Mar does not guarantee the authenticity, legality, ownership, licensing status, or intellectual property compliance of user-generated listings, products, content, or communications.
Proof of Authenticity and Ownership
Ya’Mar may require sellers to provide documentation demonstrating authenticity, ownership, sourcing, licensing, authorization, or distribution rights.
Documentation may include:

Receipts

Invoices
-
Supplier records
-
Purchase records
-
Licensing agreements
-
Distribution agreements
-
Authenticity certificates
-
Authorization letters
-
Business records
-
Other supporting documentation
Failure to provide requested documentation may result in listing removal, payout restrictions, account limitations, suspension, or termination.
Rights Owner Reports
Intellectual property owners, authorized representatives, agents, licensors, distributors, or legal representatives may report listings, content, products, images, branding, or materials believed to infringe intellectual property rights.
Ya’Mar may investigate reported content and take action where reasonably necessary.
Submission of a report does not guarantee removal, and Ya’Mar may request additional information before taking action.
False or Abusive Reports
Users may not knowingly submit false, misleading, fraudulent, abusive, malicious, or bad-faith intellectual property complaints.
False reports may result in:

Rejection of the complaint

Account restrictions

Suspension

Termination

Legal action where permitted by law

Ya’Mar Enforcement Rights
Ya’Mar reserves the right, at its sole discretion and where permitted by law, to investigate, review, remove, disable, suppress, restrict, refuse, or otherwise take action regarding content, listings, products, accounts, or transactions that may violate intellectual property rights or this Policy.

Search suppression

Account warnings

Selling restrictions

Payout holds
-
Account suspension

Account termination

Reporting violations to rights owners

Reporting violations to payment processors

Reporting violations to law enforcement

Ya’Mar may take action before, during, or after an investigation and may act without prior notice where reasonably necessary.
Repeat Infringers
Users who repeatedly violate intellectual property rights, receive multiple valid infringement complaints, repeatedly sell counterfeit products, repeatedly upload infringing content, or repeatedly violate this Policy may be permanently removed from the Platform.
Repeat violations may result in:

Permanent account termination

Permanent selling restrictions

Loss of marketplace privileges

Payout restrictions
-
Removal of listings
-
Additional enforcement measures
No Authentication Guarantee
Unless expressly stated otherwise by Ya’Mar, the Platform does not independently authenticate every product, listing, digital item, document, image, seller, or transaction.
Ya’Mar does not guarantee that products are authentic, licensed, lawful, original, non-infringing, or free from intellectual property disputes.
Users remain responsible for conducting their own due diligence before purchasing, selling, licensing, or distributing products through the Platform.
Relationship to the DMCA Policy
Copyright complaints, DMCA notices, and DMCA counter-notices are governed by the Copyright & DMCA Policy.
This Policy supplements, and does not replace, the Copyright & DMCA Policy.
Policy Updates
Ya’Mar may modify this Policy at any time to reflect changes in intellectual property laws, marketplace practices, enforcement procedures, regulatory requirements, fraud prevention practices, seller verification requirements, or business operations.
Continued use of the Platform after updates take effect constitutes acceptance of the revised Policy.
