Fees & Commissions Policy

This Fees & Commissions Policy ("Policy") is incorporated by reference into the Ya'Mar Terms of Service and applies to all users of the Ya'Mar Marketplace application, website, and related services (collectively, the "Platform").

By listing, purchasing, selling, bidding, wholesaling, shipping, fulfilling orders, receiving payouts, purchasing digital products, or otherwise participating in transactions through the Platform, users agree to comply with this Policy and all incorporated Terms and Policies.

Ya'Mar LLC ("Ya'Mar," "we," "us," or "our") may update this Policy periodically for operational needs, marketplace integrity, payment processor requirements, customs compliance obligations, shipping integration updates, fraud prevention purposes, legal compliance, or Platform security. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.
 

1. General Fee Structure

Listing items on Ya'Mar is free. Fees are generally charged only when a transaction is successfully completed, a payment is processed, a shipping adjustment occurs, a chargeback is initiated, a refund is issued, customs-related charges arise, or other applicable fees become due under Platform Policies. Certain Platform actions may also result in administrative fees, including auction cancellation fees, chargeback administration fees, shipping adjustments, carrier assessments, customs-related charges, and other fees described within this Policy or other incorporated Platform Policies.

All fees are subject to applicable laws, payment processor requirements, shipping provider requirements, customs regulations, and Platform functionality. Fees may vary depending on transaction type, location, shipping method, destination country, payment method, and other operational factors. Payment processing fees may vary based on the payment method selected by the buyer, including traditional card payments, digital wallets, bank-based payment methods, and Buy Now Pay Later (BNPL) financing services.

2. Shop Sales and Standard Marketplace Transactions

Ya'Mar applies a commission of nine percent (9%) to eligible Shop sales, fixed-price transactions, and standard marketplace purchases. This commission is calculated using the final item sale price and does not include shipping charges, taxes, customs duties, brokerage fees, or similar governmental charges unless otherwise required by law.

Sellers who bring buyers to the Platform using an approved referral link or QR code may qualify for a reduced commission rate of seven percent (7%). Referral benefits apply only to eligible transactions and sessions as determined by Ya'Mar and may be modified, limited, suspended, or discontinued at any time.

2A. Promotional Commission Programs

From time to time, Ya'Mar Marketplace may offer limited-time promotional commission programs for qualifying sellers. Unless expressly stated in the applicable promotion terms, sellers will continue to be charged Ya'Mar Marketplace's standard commission at the time of each completed transaction. Any promotional commission reductions may be provided through refunds, account credits, payout adjustments, or other methods determined by Ya'Mar Marketplace. Participation, eligibility, qualification requirements, duration, and promotional benefits are governed exclusively by the applicable Promotion Terms & Conditions.

2B. Promotional Commission Charges

Unless otherwise expressly stated in the applicable Promotion Terms & Conditions, qualifying sellers participating in a Ya'Mar Marketplace promotional commission program will continue to be charged the Platform's standard commission rate at the time each eligible transaction is completed.

Where a promotion provides for a reduced commission rate, Ya'Mar Marketplace may satisfy the promotional benefit by issuing a refund, payout adjustment, account credit, or other reimbursement equal to the difference between the standard commission and the applicable promotional commission.

Unless otherwise stated in the applicable Promotion Terms & Conditions:

  • Promotional commission refunds are generally processed during the first week of each calendar month.

  • Refunds apply only to eligible completed transactions from the immediately preceding calendar month.

  • Refunds may be delayed due to pending orders, returns, refunds, disputes, chargebacks, payment holds, fraud reviews, payout verification, banking delays, technical issues, or other administrative requirements.

  • Promotional commission refunds may be issued as a credit to the seller's Ya'Mar account balance, included with a seller payout, returned to the seller's designated payout method, or provided through another payment method determined by Ya'Mar Marketplace.

  • Sellers must continue satisfying all eligibility requirements throughout the promotional period in order to remain eligible for future promotional commission benefits.

  • Promotional commission refunds will not be issued for transactions that become ineligible due to cancellations, refunds, chargebacks, fraud, policy violations, abuse of the promotion, or other disqualifying events.

  • Promotional commission programs are optional, limited-time offers and do not permanently modify Ya'Mar Marketplace's standard commission structure.

Participation in any promotional commission program constitutes acceptance of the applicable Promotion Terms & Conditions, which govern eligibility requirements, qualification procedures, promotional duration, refund calculations, and all other program-specific rules.

3. Bidding and Auction Transactions

Transactions completed through Ya'Mar's bidding and auction systems are subject to the same commission structure as standard marketplace transactions. Winning bids are generally subject to a nine percent (9%) commission. Eligible referral or QR code transactions may qualify for a reduced seven percent (7%) commission where applicable.

All bidding activity remains subject to the Bidding Policy, Terms of Service, and other applicable Platform Policies.
 

4. Wholesale Transactions

Wholesale transactions are defined as purchases of ten (10) or more of the same item or its variations within a single transaction from the same seller.

Wholesale transactions are subject to a twelve percent (12%) commission. Eligible wholesale transactions originating through approved referral links or QR codes may qualify for a reduced commission rate of eleven percent (11%) where applicable.

Wholesale transactions remain subject to the Wholesale Policy, Terms of Service, and all applicable Platform Policies.
 

5. Digital Products

Digital products include downloadable files, templates, e-books, digital artwork, digital media, educational materials, software files where permitted, and other approved digital content.

Digital transactions are subject to a six percent (6%) commission. Eligible referral or QR code digital transactions may qualify for a reduced commission rate of five percent (5%).

Digital transactions remain subject to the Digital Items Policy, Terms of Service, and applicable Platform Policies.
 

6. Payment Processing Fees
  1. Payment Processing Fees

All transactions processed through Ya'Mar are subject to payment processing fees. Payment processing fees vary depending on the payment method selected by the buyer and may change from time to time based on payment processor pricing, financial institution requirements, regional availability, risk factors, operational changes, or supported payment methods.

Examples of current processing fees may include:

• Credit Cards, Debit Cards, Apple Pay, Google Pay, Link, Amazon Pay, and Cash App Pay: approximately 2.9% + $0.30 per transaction

• Klarna: approximately 5.99% + $0.30 per transaction

• Affirm: approximately 6.00% + $0.30 per transaction

• Afterpay / Cash App Afterpay: approximately 6.00% + $0.30 per transaction

Processing fees are assessed by payment processors and are generally deducted before seller payouts are issued. Actual fees may vary based on transaction type, location, payment method, processor requirements, financing provider requirements, or future pricing changes.

Ya'Mar reserves the right to update, modify, add, remove, or change supported payment methods and applicable processing fees at any time where permitted by law.

7. Shipping Charges and Carrier Adjustments

Shipping costs are generally paid by the buyer unless the seller elects to offer free shipping, discounted shipping, promotional shipping, or other shipping incentives.

Sellers remain solely responsible for providing accurate package weights, dimensions, package types, shipment details, and carrier information. Sellers also remain responsible for complying with carrier requirements, shipping regulations, and applicable customs requirements.

If a shipment differs from the information provided by the seller, carriers may assess additional fees including dimensional weight adjustments, postage overages, address correction fees, carrier surcharges, insufficient postage charges, or shipping label adjustments. Where permitted by law, sellers authorize Ya'Mar and its payment processors to recover such amounts from seller balances, reserves, future payouts, linked payment methods, or other available recovery methods.
 

8. International Shipping, Duties, Taxes, and Customs Charges

Eligible international transactions may utilize Delivered Duty Paid (DDP) or Delivered at Place (DAP) shipping methods where supported by the Platform.

For DDP shipments, estimated customs duties, import taxes, VAT, GST, brokerage fees, customs processing fees, and similar import-related charges may be displayed as separate line items during checkout and collected before shipment. These charges are not Ya'Mar marketplace fees and may be remitted through participating carriers, customs partners, logistics providers, governmental agencies, or other authorized third parties.

For DAP shipments, buyers may remain responsible for customs duties, import taxes, VAT, GST, brokerage fees, customs processing fees, governmental assessments, and similar import-related charges imposed by the destination country.

Sellers remain solely responsible for providing accurate customs declarations, item descriptions, declared values, package information, countries of origin, and Harmonized System (HS) tariff classification codes. Although Ya'Mar may provide HS code lookup tools, customs assistance tools, automated suggestions, or category mappings for convenience, sellers remain solely responsible for verifying the accuracy of all customs information submitted through the Platform.

If customs authorities, carriers, logistics providers, governmental agencies, or third-party service providers assess additional duties, taxes, brokerage fees, customs processing fees, storage fees, disposal fees, penalties, return shipping costs, carrier surcharges, customs adjustments, or related charges due to inaccurate customs information, inaccurate shipment information, inaccurate HS codes, inaccurate declared values, or other seller-provided information, Ya'Mar reserves the right to recover such amounts from seller balances, reserves, future payouts, linked payment methods, or other available recovery methods where permitted by law.
 

9. Chargebacks and Payment Disputes

If a buyer disputes a transaction through their financial institution, payment processor, or card issuer, the seller may be held responsible where the seller has failed to comply with Seller Protection requirements, shipping requirements, customs obligations, Platform Policies, or applicable legal requirements.

If a chargeback is issued and the seller is determined reasonably responsible, Ya'Mar may recover the transaction amount, shipping charges, refund amounts, processor penalties, dispute-related costs, administrative expenses, and other associated losses. A chargeback administration fee of $25 USD may be assessed against buyers or sellers reasonably determined responsible for fraudulent conduct, improper chargebacks, abusive disputes, duplicate refund attempts, Platform abuse, bad-faith claims, or violations of Platform Policies. This fee is generally non-refundable and may be deducted from balances, reserves, future payouts, refunds, or other amounts owed.

9A. Auction Cancellation Fees

Sellers may cancel completed Regular Bid auctions only during the cancellation period permitted under the Ya'Mar Bidding Policy. Rapid Bid auctions may only be canceled after the auction has officially ended where permitted by the Platform.

The first two (2) eligible seller-initiated auction cancellations within any rolling thirty (30) day period will not incur an Auction Cancellation Fee. Beginning with the third (3rd) eligible seller-initiated auction cancellation within the same rolling thirty (30) day period, and for each additional eligible auction cancellation thereafter, Ya'Mar may assess an Auction Cancellation Fee equal to ten percent (10%) of the final winning bid amount accepted at the close of the auction (the auction's final sale price), excluding shipping charges, taxes, duties, customs fees, payment processing fees, and any other additional charges.

The seller's cancellation count will continue until the seller completes thirty (30) consecutive days without another eligible seller-initiated auction cancellation, at which time the cancellation count will automatically reset. Auction Cancellation Fees are separate from commissions, payment processing fees, shipping charges, refund obligations, chargeback administration fees, and any other amounts owed under the Platform Policies. Ya'Mar reserves the right to deduct any applicable Auction Cancellation Fee from the seller's available balance, pending payouts, future payouts, reserves, linked payment methods, or other authorized funding sources in accordance with the Terms of Service and applicable law.

10. Payout Holds, Reserves, Negative Balances, and Recovery Rights

Ya'Mar reserves the right to delay payouts, hold funds, establish reserves, reverse payouts, restrict withdrawals, require additional verification, or temporarily limit access to earnings where reasonably necessary for fraud prevention, dispute handling, customs compliance, payment processor requirements, marketplace integrity, operational protection, legal compliance, or Platform security.

If a seller's account balance becomes negative for any reason, including refunds, chargebacks, carrier adjustments, customs-related charges, duties, taxes, brokerage fees, penalties, return shipping costs, processing adjustments, or other amounts owed, the seller authorizes Ya'Mar and its payment processors to recover such amounts from future payouts, reserves, linked payment methods, bank accounts, funding sources, or other available recovery methods where permitted by law.

Recovery rights survive account suspension, closure, restriction, termination, disputes, chargebacks, or removal of payment methods from the Platform.

Failure to satisfy outstanding balances may result in payout holds, reserve requirements, collections activity, account restrictions, permanent suspension, arbitration, legal enforcement, or other remedies permitted by law and applicable Platform Policies.
 

11. Taxes

Applicable sales taxes may be calculated, collected, remitted, withheld, adjusted, reversed, recovered, or reported where required by law. Sales taxes collected from buyers are not included in seller earnings.

Sellers remain solely responsible for reporting and paying taxes on their income, complying with tax reporting requirements, maintaining any required licenses, and satisfying applicable legal obligations. Ya'Mar does not provide legal, accounting, customs, financial, or tax advice.
 

12. Non-Refundable Fees

Unless otherwise required by law, certain fees may remain non-refundable once incurred, assessed, processed, collected, remitted, or paid. These may include payment processing fees, financing fees, processor-imposed transaction fees, or Buy Now Pay Later provider fees, chargeback administration fees, shipping label fees, carrier adjustment fees, brokerage fees, customs duties, import taxes, VAT, GST, customs processing fees, governmental assessments, carrier surcharges, currency conversion fees, international transaction fees, customs penalties, storage fees, disposal fees, and similar charges.

13. Policy Updates

Ya'Mar reserves the right to modify, update, revise, add, remove, suspend, or change commissions, fees, shipping-related charges, customs-related charges, referral benefits, processing fees, recovery rights, and other fee structures at any time. Updated versions become effective upon posting within the Platform or on Ya'Mar's website. Continued use of the Platform after updates constitutes acceptance of the revised Policy where permitted by law.

Promotional commission programs may be created, modified, suspended, or discontinued separately from this Policy and are governed by their own Terms & Conditions. Unless specifically stated otherwise, promotional programs do not modify Ya'Mar Marketplace's standard commission structure contained in this Policy.
