California Consumer Privacy Act (CCPA/CPRA) Notice

This California Privacy Notice (“Notice”) supplements the Ya’Mar Privacy Policy, Personal Data Protection & GDPR Compliance Policy, Cookie Policy, Terms of Service, and related Platform Policies.

This Notice applies solely to California residents and explains certain rights provided under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), and other applicable California privacy laws.

Ya’Mar LLC (“Ya’Mar,” “we,” “us,” or “our”) may update this Notice periodically for operational changes, legal developments, fraud prevention purposes, marketplace integrity protections, payment processor requirements, Platform security, or compliance obligations. Continued use of the Platform after updates constitutes acceptance of the revised Notice where permitted by law.

1. Scope of This Notice

This Notice applies to personal information collected through the Ya’Mar Marketplace application, website, software, systems, communications, support channels, marketing activities, and related services (collectively, the “Platform”).

This Notice explains:

  • Rights request procedures

This Notice does not apply to information exempt under applicable law.

 

2. Categories of Personal Information Collected

Ya’Mar may collect categories of personal information including:

  • Identifiers

  • Contact information

  • Account information

  • Transaction information

  • Payment-related information

  • Shipping information

  • Device information

  • Internet activity information

  • Communications

  • Verification information

  • Geolocation information derived from IP addresses or device settings

  • Commercial information

  • Customer support records

  • Fraud prevention information

  • Technical diagnostics

  • Authentication information

  • Platform usage information

Depending on Platform activity, Ya’Mar may also collect limited professional or business information, seller information, customs-related information, tax-related information, or operational records reasonably necessary for Platform operations.

Ya’Mar does not intentionally collect or process sensitive personal information for purposes requiring a “Limit the Use of My Sensitive Personal Information” right under applicable California law except where reasonably necessary for fraud prevention, security, legal compliance, payment processing, dispute handling, or operational purposes permitted by law.

3. Sources of Personal Information

Ya’Mar may collect personal information directly from users, automatically through Platform activity, through cookies and tracking technologies, from payment processors, shipping providers, telecommunications providers, analytics providers, fraud prevention providers, verification providers, advertising providers, social media integrations, business partners, service providers, affiliated entities, or publicly available sources where permitted by law.

4. Purposes for Collecting and Using Personal Information

Ya’Mar may collect, use, process, store, retain, disclose, analyze, monitor, or transfer personal information for purposes including:

  • Operating the Platform

  • Processing transactions

  • Authenticating accounts

  • Processing payments and payouts

  • Supporting shipping and delivery systems

  • Fraud prevention

  • Security monitoring

  • Customer support

  • Platform analytics

  • Operational improvements

  • Advertising and marketing

  • Dispute handling

  • Chargeback investigations

  • Customs compliance

  • Tax compliance

  • Identity verification

  • Enforcement of Platform Policies

  • Protection of marketplace integrity

  • Legal compliance

Ya’Mar may use automated systems, AI-assisted moderation systems, behavioral analysis tools, image analysis systems, machine learning technologies, fraud detection systems, and operational monitoring systems to protect the Platform, investigate disputes, detect suspicious activity, maintain marketplace integrity, and enforce Platform Policies.

Certain moderation, fraud prevention, payout review, dispute handling, or enforcement decisions may involve automated systems.

5. Disclosure of Personal Information

Ya’Mar may disclose personal information to:

  • Payment processors including Stripe

  • Shipping providers including ShipEngine

  • Fraud prevention providers

  • Cloud providers

  • Analytics providers

  • Telecommunications providers

  • Verification providers

  • Customer support providers

  • Marketing providers

  • Security providers

  • Government authorities

  • Regulators

  • Law enforcement agencies

  • Customs authorities

  • Professional advisors

  • Service providers

  • Affiliated entities

Disclosures occur only where reasonably necessary for operational purposes, legal compliance, fraud prevention, Platform security, dispute handling, payment processing, shipping operations, marketplace integrity, or related business purposes.

Ya’Mar does not sell personal information as traditionally understood under California privacy laws.

Ya’Mar also does not knowingly share personal information for cross-context behavioral advertising purposes except as permitted by applicable law and disclosed within applicable privacy disclosures.

6. Retention of Personal Information

Ya’Mar retains personal information only for as long as reasonably necessary for:

  • Operational purposes

  • Fraud prevention

  • Security monitoring

  • Payment processing

  • Shipping operations

  • Tax obligations

  • Customs compliance

  • Dispute handling

  • Chargeback investigations

  • Arbitration

  • Collections activity

  • Legal compliance

  • Regulatory compliance

  • Marketplace integrity protections

  • Enforcement of agreements

Retention periods may vary depending on the nature of the information, legal obligations, fraud prevention needs, operational requirements, security concerns, payment processor obligations, customs obligations, or dispute history.

Certain information may continue to be retained after account closure, suspension, restriction, or termination where reasonably necessary for legal compliance, fraud prevention, collections activity, dispute resolution, chargeback handling, customs compliance, tax obligations, arbitration, or protection of Platform integrity.

7. California Privacy Rights

Subject to applicable law, California residents may have rights to:

  • Request access to personal information

  • Request deletion of personal information

  • Request correction of inaccurate information

  • Request information regarding disclosures

  • Request portability of certain information

  • Opt out of certain sharing activities where applicable

  • Exercise rights without unlawful discrimination

Rights requests may require identity verification, fraud prevention review, operational review, security validation, or additional authentication before processing.

Certain requests may be limited, delayed, or denied where permitted by law for fraud prevention, account security, dispute handling, customs compliance, payment processor obligations, legal compliance, operational protection, chargeback handling, arbitration, collections activity, protection of others, or protection of marketplace integrity.

8. Authorized Agents

California residents may designate authorized agents to submit privacy requests on their behalf where permitted by law.

Ya’Mar may require:

  • Proof of authorization

  • Identity verification

  • Additional authentication

  • Operational review procedures

before processing authorized agent requests.

9. Non-Discrimination

Ya’Mar will not unlawfully discriminate against users for exercising applicable California privacy rights.

However, certain Platform functionality, transaction processing capabilities, dispute handling procedures, fraud prevention measures, or operational services may require the processing of personal information necessary for Platform operation, legal compliance, payment processing, customs compliance, marketplace integrity, or security purposes.

10. Minors

Ya’Mar does not knowingly sell or knowingly share personal information of minors under sixteen (16) years of age for cross-context behavioral advertising purposes without legally required authorization.

Where minors are permitted to access limited Platform features under adult supervision, parents or legal guardians remain responsible for supervising Platform use, monitoring account activity, and ensuring compliance with applicable laws and Platform Policies.

11. Cookies and Tracking Technologies

Ya’Mar may use cookies, SDKs, pixels, analytics technologies, authentication technologies, fraud prevention technologies, device identifiers, and related tracking technologies to support Platform functionality, fraud prevention, analytics, advertising measurement, security monitoring, and operational purposes.
